回应性监管理论及其本土适用性分析

【摘要】：法和社会学视角之下的回应性监管理论对弥补政治经济学视角下监管研究的不足有重要作用。该理论提出了纵向的监管策略和横向的监管主体间监管权分配的方案,并发展出一系列衍生理论,意在构建出监管活动的新模式。具有该理论特点的监管实践在西方国家取得了显著成效,对我国的监管理论和实践提供了重要启示。然而,该理论在我国本土的运用还面临着诸多问题。我国可以通过一定的措施改善回应性监管理论的适用性,以实现监管的善治。
[Abstract]:The responsive supervision theory from the perspective of law and sociology plays an important role in making up for the deficiency of supervision research in the perspective of political economy. The theory puts forward the vertical supervision strategy and the horizontal scheme of supervision power distribution among the regulators, and develops a series of derivative theories, which is intended to construct a new model of regulatory activities. The regulatory practice with the characteristics of this theory has achieved remarkable results in western countries, and has provided important enlightenment to the supervision theory and practice of our country. However, the application of this theory in China also faces many problems. Some measures can be taken to improve the applicability of responsive supervision theory in order to achieve good governance.
