行政监督多元主体间协同生成机制构建研究

【摘要】：随着中国特色社会主义建设的不断推进,我国的社会主义民主政治建设得到了深入发展,基本上建立了由中国共产党、国家权力机关、国家司法机关、政协、社会团体和个人以及行政机关系统本身等多元主体组成的行政监督体系,各行政监督主体在各自的职责范围内对党和政府进行了有效的监督,并取得了一定的成效。党的十八届三中全会审议通过的《中共中央关于全面深化改革若干重大问题的决定》指出必须构建决策科学、执行坚决、监督有力的权力运行体系,而在现行的行政监督体制下,虽然各行政监督主体在对权力运行的规范化方面做出了贡献,但是由于多元的监督主体之间的关系混乱,在监督权限、方式、程序、范围等方面存在着不同程度的不足之处,使监督工作难免存在“交叉带”和“空白带”。因此,要强化权力运行制约和监督体系,必须实现各监督主体的协同。协同是一个物理学的概念,研究的是开放系统内的各个子系统相互协作从而产生宏观有序结构的过程。行政监督体系是一个开放的系统,多元的监督主体即是构成这个开放系统的子系统,行政监督多元主体协同是指行政监督各个主体子系统在序参量支配下相互协作、统一步调从而使行政监督系统结构有序、合力提升的运动过程。行政监督多元主体协同的生成机制的构建是明确行政监督主体权责、提高监督合力的需要,是提高行政监督主体素质、提升监督科学性的需要,是提高行政监督主体独立性、提升行政监督权威的需要。构建行政监督主体协同的生成机制是可行的,首先行政监督主体目标的共性符合协同生成机制的构建前提,其次行政监督主体无序状态为协同生成机制的构建提供了契机,最后行政监督主体自愿配合为协同生成机制的构建提供了关键条件。行政监督多元主体协同的生成机制是一个过程,主要包括行政监督主体协同的动因、行政监督主体协同的具体展开以及行政监督主体协同的结果反馈。根据反馈结果发现,行政监督多元主体协同的生成机制还存在着一定的问题,需要从以下几个方面进行优化:提升协同理念、营造行政监督主体协同生成机制运行的氛围,深化体制改革、设置行政监督主体协同生成机制运行的组织结构,搭建协同平台、提供行政监督主体协同生成机制运行的外部保障。
[Abstract]:With the continuous development of the socialist construction with Chinese characteristics, the socialist democratic political construction in our country has been developed in depth, basically established by the CPC, the organs of state power, the state judicial organs, the CPPCC, The administrative supervision system composed of social organizations and individuals and the administrative organ system itself, each administrative supervision subject has carried on the effective supervision to the party and the government in their respective duty scope, and has obtained the certain effect. The "decision of the CPC Central Committee on several important issues on comprehensively deepening Reform", which was deliberated and adopted at the third Plenary session of the 18th CPC Central Committee, pointed out that it is necessary to establish a scientific decision-making system, resolutely implement and supervise a powerful system of power operation. Under the current administrative supervision system, although various administrative supervisory subjects have made contributions to the standardization of the operation of the power, due to the confusion of the relationship between the pluralistic supervisory subjects, they are in the supervisory authority, the mode, and the procedure. There are some deficiencies in the scope, which make the supervision work inevitably exist "cross zone" and "blank zone". Therefore, in order to strengthen the power operation restriction and supervision system, we must realize the coordination of all supervisory bodies. Cooperation is a physical concept. It studies the process of cooperation among subsystems in open system, which results in a macroscopic ordered structure. The administrative supervision system is an open system, and the pluralistic supervisory subject is the subsystem that constitutes the open system. The unified step makes the administrative supervision system structure orderly and promotes the movement process. The formation mechanism of administrative supervision multi-subject coordination is the need to clarify the power and responsibility of administrative supervision subject, to improve the supervision resultant force, to improve the quality of administrative supervision subject, to enhance the scientific nature of supervision, and to improve the independence of administrative supervision subject. The need to upgrade the authority of administrative supervision. It is feasible to construct the coordination mechanism of the administrative supervision subject. Firstly, the commonness of the administrative supervision subject object accords with the premise of constructing the coordination generation mechanism. Secondly, the disordered state of the administrative supervision subject provides an opportunity for the construction of the coordination generation mechanism. Finally, the voluntary cooperation of administrative supervisors provides the key conditions for the construction of cooperative generation mechanism. The forming mechanism of administrative supervision multi-agent coordination is a process, which mainly includes the motivation of administrative supervision subject coordination, the concrete development of administrative supervision subject coordination and the result feedback of administrative supervision subject coordination. According to the feedback results, there are still some problems in the mechanism of administrative supervision multi-agent coordination, which need to be optimized from the following aspects: to promote the concept of coordination, to create an atmosphere for the operation of administrative supervision agent coordination generation mechanism. Deepening the reform of the system, setting up the organization structure of the cooperative generation mechanism of the administrative supervision subject, setting up the cooperative platform, providing the external guarantee for the operation of the cooperative generation mechanism of the administrative supervision subject.
