青少年犯罪教育改造问题研究

【摘要】:中国作为一个发展中国家,近几十年国家经济取得长足发展,尤其是改革开放以来,我国发生了翻天覆地的变化,市场经济持续繁荣发展,社会生产力不断提高,国家综合实力显著增强,,人民群众的生活水平和安全感、满意度都有所提升,社会主义各项事业日新月异。但与此同时,伴随经济的快速发展,我国的各种社会矛盾开始凸显,贫富差距也在逐渐拉大,城市与农村、中西部与东部沿海地区经济差距悬殊,社会治安不稳定,滋生出许多新问题、新情况。尤其是青少年犯罪问题越来越突出,已经成为威胁国家治安稳定亟需解决的社会性难题。 近年来,青少年犯罪已成为全球注目的社会问题,青少年犯罪不仅人数增多,而且涉及面广,在犯罪人员中,青少年犯罪比例最高。我国青少年犯罪居高不下,一直是一个比较严重的社会问题。如今青少年犯罪已被国际社会列为第三大公害,引起全球各个国家的高度重视。青少年时期,是一生中的黄金时代,是世界观的形成阶段,是决定一个人有无作为的关健时刻,具有精力充沛、记忆清晰,思维敏捷等优点,但也存在着思维片面,情感不稳定,容易冲动,行为偏激等弱点,引导不好,容易养成不良习惯,走上犯罪道路,我国近几年来各类刑事案件有增无减,呈上升趋势,青少年犯罪案件尤为突出。因此,客观形势要求我们必须有效地预防和控制青少年违法犯罪,通过行之有效的教育改造措施以及心理干预使青少年改过自新、回归社会。 基于以上问题,我做了《青少年犯罪教育改造问题研究》论文,希望通过分析和论述提供一些预防和减少青少年犯罪问题的措施。本论文共分为以下几个部分:第一部分主要是通过对青少年犯罪的特点进行分析,以青少年犯罪问题为研究对象,从五个方面(犯罪低龄化的趋势日益明显、辍学青少年违法犯罪率直线上扬、青少年暴力犯罪居高不下、青少年犯罪团伙化趋势增加、再犯罪率较高)来分析当今青少年犯罪的情况,了解青少年犯罪的特点,从而引出我国青少年犯罪问题的严重性。第二部分主要分析青少年犯罪的类型、诱因及监管状态,通过研究青少年犯罪的类型解析这类人群引发犯罪的不良因素,由于犯罪的惩罚性,青少年犯罪被关押在监管场所后引起一些不良情绪及心理状态。第三部分主要分析我国青少年犯罪教育改造的问题,由教育改造的难题入手,分析青少年犯罪教育改造的缺陷。第四部分分析青少年犯罪教育改造思路,提出具体的教育改造措施及建议。
[Abstract]:As a developing country, China has made great progress in its economy in recent decades. Especially since the reform and opening up, great changes have taken place in our country. The market economy continues to flourish and the social productivity continues to improve. The overall strength of the country has increased significantly, the people's living standards, security, and satisfaction have improved, and socialist undertakings are changing with each passing day. But at the same time, with the rapid development of economy, all kinds of social contradictions in our country begin to highlight, the gap between the rich and the poor is gradually widening, the gap between cities and rural areas, the economic gap between the central and western regions and the eastern coastal areas, and the social security is unstable. There are many new problems and new situations. Especially the problem of juvenile delinquency is becoming more and more prominent, which has become a social problem that threatens the stability of national security. In recent years, juvenile delinquency has become a global social problem. Juvenile delinquency not only increases in the number of people, but also covers a wide range. Among the criminals, the proportion of juvenile delinquency is the highest. The high level of juvenile delinquency in our country has always been a serious social problem. Nowadays, juvenile delinquency has been listed as the third public hazard by the international community, which has aroused the attention of all the countries all over the world. Adolescence is a golden age in life, a stage in the formation of the world outlook, and a crucial moment to determine one's actions. It has the advantages of energy, clear memory, quick thinking, and so on, but there is also a one-sided thinking. Emotional instability, impulsive, extreme behavior and other weaknesses, poor guidance, easy to cultivate bad habits, on the road to crime, in recent years, all kinds of criminal cases in China have increased, showing an upward trend, juvenile delinquency cases are particularly prominent. Therefore, the objective situation requires us to effectively prevent and control juvenile delinquency, through effective measures of educational reform and psychological intervention to make the youth reform and return to society. Based on the above problems, I have done a study on the reform of juvenile delinquency education, hoping to provide some measures to prevent and reduce juvenile delinquency through analysis and discussion. This paper is divided into the following parts: the first part is mainly through the analysis of the characteristics of juvenile delinquency, taking juvenile delinquency as the research object, from five aspects (the trend of the younger age of crime is increasingly obvious, The rate of juvenile delinquency has risen sharply, the violent juvenile crime rate remains high, the trend of gang youth delinquency is increasing, and the rate of recidivism is high.) to analyze the situation of juvenile delinquency today and to understand the characteristics of juvenile delinquency, In order to lead to the seriousness of juvenile delinquency in China. The second part mainly analyzes the types of juvenile delinquency, inducement and the state of supervision. By studying the types of juvenile delinquency, the author analyzes the bad factors that lead to the crime of this kind of people, because of the punitive nature of the crime. Juvenile delinquency after being held in the custody of some bad mood and psychological state. The third part mainly analyzes the reform of juvenile delinquency education in China, starting with the difficult problems of education reform, analyzes the defects of juvenile delinquency education reform. The fourth part analyzes the thinking of juvenile delinquency education reform, and puts forward concrete measures and suggestions.
