大学生法律意识的培养研究

【摘要】：大学生是社会经济建设主要力量,是知识经济时代宝贵的人才资源,是最有希望的高层次、高素质、高智商的社会群体。然而,近些年来,身处象牙塔的大学生却多次出现违反道德伦理、触犯法律法规的情况,又或者,因缺乏法律意识,越来越多的大学生成为违法犯罪的对象和牺牲品。对此,本文结合诸多典型案例,利用文献研究、实证调研、访谈的方法,通过多方面、多视角、多层次的方法展现出学好法律知识,提高高校法律教育质量、以及培养“德才兼备”型人才的重要意义,并对当代大学生法律意识缺失的原因进行分析,提出相应的培养路径。本文首先对法律意识的相关概念进行了科学的界定,并对其特征、结构进行了多角度多层次的阐述。其次,通过对几所非法律本科院校展开的问卷调查,分析发现大学生中普遍存在对法律认知、法律掌握程度及其运用,法律权利意识、法律实践参与度方面知识掌握不清、理解不深、运用不熟练等多方面的问题,主要是受传统法治文化和现当代法治文化因素、高等教育课程设置不合理、法律实践薄弱、依法治校水平低等教育因素、以及社会与法律因素、家庭与个人因素的影响制约。为此,目前我国高等院校学生法律意识的培养途径应为:首先要丰富文化、营造完善的法治信仰环境,优化社会和高校的法律文化。其次应当设置科学的教学课程、加强法律实践教学、提升依法治校水平、强化教师队伍建设。再次要加强我国社会中法治教育管理与道德素养建设,净化当前社会生产、生活环境,构建全民遵法、守法风尚。最后,父母应该以自身为榜样,激发大学生自我觉醒,养成大学生遵法守法、崇尚法律的意识。本文通过上述四种路径,对我国当前高等院校中学生进行法律意识培养,希望能帮助他们树立正确的价值观、理性地面对生活,合理地做出选择,成为对社会主义建设有用的优秀人才。
[Abstract]:College students are the main strength of social and economic construction, the valuable talent resources in the era of knowledge economy, and the most promising high level, high quality and high intelligence social group. However, in recent years. College students in the ivory tower appear many times to violate the moral ethics, violate the laws and regulations, or, because of the lack of legal awareness, more and more college students become the object and victim of illegal crimes. This paper combines many typical cases, using literature research, empirical research, interview methods, through various, multi-perspective, multi-level methods to demonstrate the law knowledge, improve the quality of legal education in colleges and universities. And the important significance of cultivating "both moral and talented" talents, and the reasons for the lack of legal consciousness of contemporary college students are analyzed. This paper firstly defines the related concepts of legal consciousness scientifically, and expounds its characteristics and structure from many angles and levels. Secondly. Through the questionnaire survey of several non-law universities, it is found that there is a general awareness of the law, the degree of legal mastery and its application, and the awareness of legal rights among the college students. There are many problems in the aspects of participation in legal practice, such as unclear knowledge, unclear understanding and unskilled application, which are mainly due to the traditional rule of law culture and modern and contemporary rule of law culture factors, and the unreasonable curriculum design of higher education. The legal practice is weak, the educational factors such as the low level of running schools according to law, as well as the influence of social and legal factors, family and individual factors. At present, the ways to cultivate students' legal consciousness in colleges and universities in our country should be as follows: firstly, we should enrich culture, create a perfect environment of belief in the rule of law, and optimize the legal culture of society and colleges, and secondly, we should set up scientific teaching courses. Strengthen the practice of law teaching, improve the level of school management according to law, strengthen the building of teachers. Thirdly, strengthen the rule of law education management and moral literacy in our society, purify the current social production, living environment. Finally, parents should follow their own example, stimulate the self-awareness of college students, develop their awareness of abiding by the law and advocating the law. In order to cultivate the legal consciousness of middle school students in colleges and universities in our country, we hope to help them to set up correct values, face life rationally, make reasonable choices, and become useful talents in socialist construction.
