当代中国大学协商治理机制探析

【摘要】:协商治理的理论主要来源于协商民主理论及其在公共治理领域的应用,它主张在公共事务的管理过程中,自由平等的公民在信息充分、程序公正的条件下,对公共政策进行理性思考和公开讨论,依靠说服达到个体价值和偏好的转换,从而赋予决策正当性和合法性。大学协商治理是协商民主在基层的实践形式,它建立于权力在成员之间分享的理念上,具体表现为大学不同利益主体对大学的合作共治。但多元主体也带来了多元化的利益诉求,且其诉求与大学的发展目标并不具有天然一致性;在治理实践中,“过度政府”、“被动治理”、“行政本位”等问题也一直存在。协商治理强调个体对于公共利益的责任,重视对民意质量的提升,希望通过不断地对话和协商,使各方都能了解彼此的立场,把个人诉求提升为共识性决议,其主张的理性包容和平等协商理念正可为中国大学走出治理困境提供指导。但协商理念不是天然植入大学机理之中的,往往需要大学内部和外部共的同作用。我国经济多元所有制结构和政治空间独特性以及快速普及的信息技术,为我国大学的协商治理提供了可能性。同时,大学的本质特点及我国大学治理的现实困境,也为协商民主嵌入大学治理提供了必要性。20世纪80年代以来,西方国家鉴于各自的历史传统和现实背景,对高校推进协商治理进行了探索,并取得了良好的治理效果。在借鉴国外经验的基础上,中国大学可以从价值理念完善、路径平台选择、规章制度设计三个方面来构建符合中国国情的大学协商治理机制。对处于转型期的中国大学而言,这不仅有助于促进大学成员之间的良性互动,还可以丰富大学治理的内在要素,为推动中国现代大学制度的建立提供有益的探讨。
[Abstract]:The theory of consultative governance is mainly derived from the theory of deliberative democracy and its application in the field of public governance. It advocates that in the management of public affairs, free and equal citizens should have sufficient information and fair procedures. Rational thinking and open discussion of public policy, relying on persuasion to achieve the conversion of individual values and preferences, endows decision-making with legitimacy and legitimacy. University consultative governance is the practical form of consultative democracy at the grass-roots level. It is based on the idea of power sharing among the members, which is embodied in the cooperation and co-administration of different interests of the university to the university, but the pluralistic subjects also bring about diversified interests. In the practice of governance, such problems as "excessive government", "passive governance" and "administrative standard" exist all the time. Attaching importance to the improvement of the quality of public opinion and hoping that through continuous dialogue and consultation, all parties will be able to understand each other's positions and raise their personal demands to consensus resolutions, His idea of rational tolerance and equal consultation can provide guidance for Chinese universities to get out of the dilemma of governance, but the idea of consultation is not naturally embedded in the mechanism of universities. The multiple ownership structure of our economy and the uniqueness of political space, as well as the rapid spread of information technology, provide the possibility for the consultative governance of our universities... at the same time, The essential characteristics of universities and the realistic predicament of university governance in our country also provide the necessity for the negotiation democracy to embed university governance. Since 80s, the western countries have given their own historical tradition and realistic background. This paper explores the promotion of consultative governance in colleges and universities, and obtains good governance results. On the basis of learning from foreign experience, Chinese universities can improve their value concept and choose a path platform. Three aspects of regulatory design are designed to build a consultative governance mechanism for universities in accordance with China's national conditions. For Chinese universities in transition, this will not only help to promote positive interaction among university members. It can also enrich the internal elements of university governance and provide a useful discussion for promoting the establishment of modern university system in China.
