构建政府、社会和高校三元治理模式

【摘要】：政府、社会和高校的三元治理模式,强调高等教育管理权在政府、社会团体和高校之间的分散和制衡。三元治理模式的关键是制度创新,包括宏观上政府简政放权的制度创新、中观社会团体的制度创新和微观高校自主权的制度创新。宏观政府的制度创新,主要是指政府的简政放权,把一些权力和职能让渡给社会团体和高校,并建立和完善相关的机构和制度。中央和省级政府建立高等教育发展规划委员会、高等教育质量监督与管理委员会及高等教育拨款委员会。中观社会团体的制度创新,不仅要关注到政府权责内的全国性重大问题,还要关注高校实践领域的各种具体问题。出台社会团体法人资格法规;增设有关社会团体管理权限的法律规定;制定社会团体运行模式的政策。微观高校自主权的制度创新,需要从确立高校的法人实体地位着手,理顺高校内部治理机构中的党政和教师、学生及相关利益主体的关系,并以党政关系为主轴进行制度创新:制定高校法人实体的相关法律制度;加快高校内董事会制的改革,实行高校内领导体制董事会制。
[Abstract]:The ternary governance model of government, society and universities emphasizes the decentralization and balance of higher education management power among government, social organizations and universities.The key to the ternary governance model is institutional innovation, including the institutional innovation of the government's decentralization, the institutional innovation of the meso-social group and the institutional innovation of the autonomy of the micro-university.The system innovation of macro government mainly refers to the simplification of government power, the transfer of some powers and functions to social organizations and universities, and the establishment and improvement of relevant institutions and systems.The central and provincial governments set up higher education development planning committee, higher education quality supervision and management committee and higher education appropriation committee.The system innovation of the middle social organization should not only pay attention to the national major problems in the government's power and responsibility, but also pay attention to various concrete problems in the practice field of colleges and universities.To introduce laws and regulations on the qualification of social organizations as legal persons, to add laws and regulations on the management authority of social organizations, and to formulate policies for the operation mode of social organizations.The institutional innovation of the autonomy of microcosmic colleges and universities needs to start with the establishment of the entity status of legal persons in colleges and universities, and straighten out the relationship between the party and government, teachers, students and relevant stakeholders in the internal governance institutions of colleges and universities.The system innovation is based on the relationship between the Party and the government: the establishment of the relevant legal system of the legal entity in colleges and universities, the acceleration of the reform of the board of directors system in colleges and universities, and the implementation of the board of directors system of the leadership system in universities.
