论我国反校园欺凌的实践困惑与立法构想

【摘要】:法律制度因其权威性、稳定性和可预见性,在治理校园欺凌中能发挥重要价值。新时期校园欺凌行为呈现出一些新的表现特点,这是社会结构变迁及规则缺失、学校治理无力及无奈、家庭结构变迁及失能、学生个体差异性特征共同导致的结果。校园欺凌依法治理的实践主要表现为反校园欺凌的制度设计、司法应对、学校角色、社会参与几个方面,但存在对校园欺凌后果严重性认识不足,治理校园欺凌的责任主体不明确,治理校园欺凌的方法缺乏有效性等问题。校园欺凌有效治理需要推进专项立法,明确反校园欺凌立法目的与原则、理清立法主要内容以及明晰参与主体责权利边界。
[Abstract]:Because of its authority, stability and predictability, the legal system can play an important role in the management of bullying on campus. The behavior of bullying on campus in the new period presents some new characteristics, which is the result of the change of social structure and the lack of rules, the powerlessness and helplessness of school governance, the change and disability of family structure, and the characteristics of individual difference of students. The practice of administering campus bullying according to law is mainly manifested in the system design of anti-campus bullying, judicial response, school role and social participation, but there is insufficient understanding of the seriousness of the consequences of campus bullying. The main responsibility of controlling bullying on campus is unclear, and the methods of dealing with bullying on campus are not effective. The effective management of campus bullying needs to promote special legislation, clear the purpose and principle of anti-campus bullying legislation, clear the main content of legislation and clarify the rights and responsibilities of participating subjects.
