【摘要】：随着依法治国、依法治校的深入和现代大学制度的建立，以及高等学校面向社会办学自主权的进一步扩大，大学章程越来越备受关注。本文选取粤港台三地典型大学章程进行比较研究。广东外语外贸大学是广东最早设立大学章程的学校，，同时《广东外语外贸大学章程》是大陆省属高校出台的第一部大学章程。香港大学条例制度和台湾大学法有着悠久的历史，积累了丰富的经验，制度发展得比较完善，已引起世人的关注。作为中国不可分割的一部分，香港、台湾与内地同根同源，一脉相承，和内地有着相近的文化背景和社会观念，这使得三地大学章程比较具有可行性。分析各自文化背景下教育法律制度的异同，比较分析的基础上得到一些启发，对建立和健全大陆大学章程制度提出几点建议：一是大学章程制定必须有明确的法源;二是大学章程必须权威和全面;三是大学章程必须由大学自主制定;四是大学章程必须明晰大学的治理结构。对促进大陆大学健康发展具有十分重要的意义。
[Abstract]:With the development of governing the country according to law, the establishment of modern university system, and the further expansion of the autonomy of colleges and universities facing the society, the university charter has been paid more and more attention. This article selects Guangdong, Hong Kong and Taiwan to carry on the comparative research on the typical university charter. Guangdong University of Foreign Studies is the earliest university in Guangdong to set up the charter of the university. At the same time, the charter of Guangdong University of Foreign Trade is the first university charter issued by universities in mainland China. The statute system of the University of Hong Kong and the laws of the University of Taiwan have a long history, have accumulated rich experience, and the system has developed relatively well, which has attracted the attention of the world. As an inseparable part of China, Hong Kong, Taiwan and the mainland have the same roots, same lineage, and similar cultural background and social concept with the mainland, which makes the statutes of the three universities more feasible. This paper analyzes the similarities and differences of educational legal system under their respective cultural background, and gets some enlightenment on the basis of comparative analysis, and puts forward some suggestions for establishing and perfecting the constitution system of mainland universities: first, the establishment of university charter must have a clear legal source; Second, the university charter must be authoritative and comprehensive; third, the university charter must be independently formulated by the university; fourth, the university charter must clarify the governance structure of the university. It is of great significance to promote the healthy development of mainland universities.
