我国大学内部治理结构改革的困境与出路

【摘要】：目前,我国高校的改革和发展存在着诸多问题,总体来讲,是大学内部各方权力失衡。具体来讲则表现为：党政权责不清；行政权力泛化,学术权力弱化；教师和学生的民主权力得不到落实等等。这诸多问题反映出了我国大学内部治理结构不合理的事实,这种结构不合理不仅导致了大学内部各利益主体矛盾突出,也严重影响了学校的教学、科研、社会服务的质量。因此,如何完善现代大学治理结构,平衡各种力量,兼顾各权利主体利益,就成了高教理论界研究的一个热点问题。从现有的理论研究来看,学者们根据不同的理论,从不同的视角提出了各种策略和建议。从实践探索来看,部分高校在借鉴国外经验的基础上,进行了以实施董事会制度、教授治学制度为核心的内部治理结构改革。然而目前不管是高校进行的董事会制度还是教授治学制度改革都存在着诸多问题,如在董事会制度改革中,董事会的地位不明确、功能发生异化、权力运行缺乏法律依据等；在高校教授治学制度改革中,教授拥有的学术权力还不够,学术权力行政化现象依然存在。以上问题的存在严重影响和制约着高校内部治理结构的改革成效。笔者认为,大学内部治理结构改革是一项复杂的系统工程,其成功与否不仅取决于高校自身的改革措施是否得当,也取决于法律、教育体制是否健全以及社会环境的好坏。为此,本文在阐述了大学内部治理结构改革困境后,从政府、法律、社会及高校自身等方面入手,着重分析了高校大学内部治理结构改革面临困境的原因,并试图通过委托——代理理论、博弈论等理论以及借鉴美国大学内部治理结构的成功经验,结合我国国情、校情提出进一步完善大学内部治理的对策建议。
[Abstract]:At present, there are many problems in the reform and development of colleges and universities in our country. Concretely speaking, the party and government are not clear; the administrative power is generalized and academic power is weakened; the democratic power of teachers and students can not be implemented, and so on. These problems reflect the fact that the internal governance structure of universities in our country is unreasonable, which not only leads to the prominent contradictions among the main bodies of interest in universities, but also seriously affects the quality of teaching, scientific research and social services. Therefore, how to perfect the governance structure of modern universities, balance all kinds of forces, and give consideration to the interests of each right subject has become a hot issue in the theoretical circle of higher education. From the current theoretical research, scholars put forward various strategies and suggestions from different perspectives according to different theories. Based on the experience of foreign countries, some colleges and universities have carried out the reform of internal governance structure with the implementation of the board of directors system and the system of academic research by professors as the core. However, there are many problems in the reform of the board of directors system or the academic system of professors in colleges and universities. For example, in the reform of the board of directors system, the status of the board of directors is not clear, the functions of the board of directors are dissimilated, the power operation lacks the legal basis and so on. In the reform of academic system of university professors, the academic power of professors is not enough, and the phenomenon of administrative academic power still exists. The existence of the above problems seriously affects and restricts the reform effect of the internal governance structure in colleges and universities. The author believes that the reform of university internal governance structure is a complex systematic project. Its success depends not only on the proper reform measures of the university itself, but also on the law, the sound education system and the good or bad social environment. Therefore, after expounding the dilemma of the reform of university internal governance structure, this paper analyzes the reasons why the reform of university internal governance structure is facing difficulties from the aspects of government, law, society and universities themselves. Through the principal-agent theory, game theory and the successful experience of the internal governance structure of American universities, combined with the situation of our country, this paper puts forward some countermeasures and suggestions to further improve the internal governance of universities.
