临床实践教学中的权责失衡及出路——基于《医学教育临床实践管理暂行规定》视角的分析

【摘要】：《医学教育临床实践管理暂行规定》作为专门规范临床实践教学的规章,存在医学生诊疗资格"合理不合法",各方主体权、责界定不清等诸多法律问题。亟待在权利义务"明确、对等"原则的基础上明晰各相关主体的权利边界与法律责任,调整教学实习课时体系,解决医学生实习不具医师身份而触法的问题;确立医学院校的补充责任,解决教学基地与医学院校之间的权责失衡;增设医学生重大过失时的民事责任,解决医学生与带教教师的冲突;与患者签订知情同意合同,解决医学生实习权与患者权利的权责失衡,以保障实践教学合法、有序进行。
[Abstract]:As a special regulation to standardize clinical practice teaching, there are many legal problems such as "reasonable and illegal" medical students' qualification for diagnosis and treatment, the right of each party and the unclear definition of responsibility and so on. On the basis of the principle of "clear and equal rights and obligations", it is urgent to clarify the right boundary and legal responsibility of all relevant subjects, adjust the teaching practice class system, and solve the problem that medical students' practice does not have the status of doctors. To establish the supplementary responsibility of medical colleges and universities, to solve the imbalance between teaching bases and medical colleges and universities, to increase the civil liability of medical students in the event of gross negligence, to resolve the conflicts between medical students and teaching teachers, and to sign informed consent contracts with patients, To solve the imbalance between the right of practice and the rights of patients in order to ensure the legal and orderly implementation of practical teaching.
