高校思想政治教育法治环境构建研究

【摘要】：法治是治国理政的基本方式,党的十八大提出“全面推进依法治国”,①继中国特色社会主义法律体系形成之后,“法治思维”和“法治方式”的提出,推进法治建设,这为高校思想政治教育环境的建设提供了新的视角。在这个新视角下,依托宪法和法律,完善高校思想政治教育工作的体系,将法律作为准绳,推进高校思想政治教育法治环境的构建,以此形成高校思想政治教育工作科学的规范的工作机制,这既符合当下的高校思想政治教育工作不断发展的实际需要,也符合当前依法治国的时代要求,因此,不论是从高校的层面还是从国家的层面,高校思想政治教育法治环境的构建都具有很大的理论与实践意义。本文分别从理论、实践两大方面对高校思想政治教育法治环境进行了探析。共分为三大部分：首先,论述了高校思想政治教育法治构建的相关概念,特别以马克思主义关于人的全面发展理论、邓小平“两手抓”的精神文明建设理论、江泽民关于依法治国的理论、胡锦涛的科学发展观关于“科学发展”理论为基础,阐述了高校思想政治教育法治环境构建的必要性；其次,通过调查问卷,从法治角度探讨了高校思想政治教育法治环境构建过程中在教育者、受教育者、载体三个方面存在的问题,并据此分析了其原因；最后,阐述高校思想政治教育法治环境构建的四个基本原则,着重从教育者、受教育者、载体三大方面探析了高校思想政治教育法治环境构建的途径：一是加强高校思想政治教育教育者法治思维培养,强调培养高校思想政治教育教育者运用法治方式意识,树立以人为本的理念,培养和提升高校思想政治教育教育者的法律素质；二是推进高校思想政治教育受教育者的法律素养培养,强调增强受教育者的法律意识,促使其养成“学法、懂法、守法、用法”的观念：三是发挥高校思想政治教育载体所具有的积极作用。不断创新载体具有的教育作用,创建平台,并将高校思想政治教育环境融合进校园法治文化之中,推动高校思想政治教育制度化、科学化发展。
[Abstract]:The rule of law is the basic way of governing the country and governing by law. The 18th National Congress of the Communist Party of China put forward "comprehensively promoting the rule of law", 1 after the formation of the socialist legal system with Chinese characteristics, the "thinking on the rule of law" and "the way of ruling by law" were put forward to promote the construction of rule by law This provides a new perspective for the construction of ideological and political education environment in colleges and universities. From this new angle of view, relying on the constitution and law, we should perfect the system of ideological and political education in colleges and universities, regard the law as the yardstick, and promote the construction of the legal environment of ideological and political education in colleges and universities. In order to form a scientific and standardized work mechanism of ideological and political education in colleges and universities, this is not only in line with the actual needs of the continuous development of ideological and political education in colleges and universities, but also in accordance with the requirements of the current times of governing the country according to law. It is of great theoretical and practical significance to construct the legal environment of ideological and political education in colleges and universities, both from the level of colleges and universities and from the level of the country. This paper analyzes the legal environment of ideological and political education in colleges and universities from the aspects of theory and practice. It is divided into three parts: firstly, it discusses the related concepts of the construction of the rule of law in the ideological and political education in colleges and universities, especially with the Marxist theory on the all-round development of human beings, Deng Xiaoping's theory of spiritual civilization construction with "two hands at the same time". On the basis of Jiang Zemin's theory of governing the country by law and Hu Jintao's view of scientific development on the theory of "scientific development", this paper expounds the necessity of constructing the legal environment of ideological and political education in colleges and universities. Secondly, from the point of view of rule by law, this paper discusses the problems existing in the process of constructing the legal environment of ideological and political education in colleges and universities in three aspects: educator, educatee and carrier, and analyzes the reasons therefrom. Finally, this paper expounds the four basic principles of constructing the legal environment of ideological and political education in colleges and universities, focusing on educators and educatees. This paper probes into the ways of constructing the legal environment of the ideological and political education in colleges and universities in three aspects: first, to strengthen the cultivation of the thought of the rule of law of the ideological and political educators in colleges and universities, and to emphasize the cultivation of the consciousness of the way of the rule of law in Set up the idea of people-oriented, cultivate and improve the legal quality of ideological and political educators in colleges and universities; Second, it is necessary to promote the cultivation of the legal literacy of the educated in ideological and political education in colleges and universities, emphasizing the enhancement of the legal consciousness of the educatees and encouraging them to "learn and understand the law and abide by the law." The concept of usage: third, give play to the positive role of the carrier of ideological and political education in colleges and universities. In order to promote the institutionalization and scientific development of ideological and political education in colleges and universities, the ideological and political education environment in colleges and universities is integrated into the campus culture of rule of law.
