我国公立高校教师民主管理权研究

【摘要】：高校教师权利保障问题是高等教育理论界研究的热点和核心问题，而高校教师民主管理权却很少有人专门深入地研究。随着高校教师聘任制的实施，高校教师与大学之间的关系发生了变化，，高校教师角色定位模糊，高校教师的合法权利无法得到保障。基于以上原因，本研究围绕高校教师民主参与大学管理的内容、高校教师希望参与大学管理的意愿和实际参与程度等方面的问题，采用问卷法和访谈法对我国十所公立高校教师进行调查，并找出高校教师民主管理权无法落实的原因，提出保障我国公立高校教师民主参与大学管理的策略。本研究共由六部分组成：第一部分，引言。总体交代了本研究的缘起，介绍了本研究的选题背景、研究目的及意义、相关概念的界定、文献综述、研究方法与思路。其中，在文献综述中，主要从教师权利保障和高校教师民主管理权两方面进行综述，明确了本研究的理论价值和实践意义。第二部分，我国公立高校教师参与大学民主管理的基本内容与法律依据。本部分主要对我国高校教师参与大学民主管理的内容和高校教师民主管理权的法理依据两部分内容进行阐述，为研究的进一步深入奠定了理论基石。第三部分，我国公立高校教师民主管理权实施现状调查分析。本部分通过问卷调查和图表分析所获得的第一手材料，对我国公立高校教师民主管理权的实施现状进行分析，找出我国公立高校教师民主管理权实施存在的问题及原因，以此作为提出对策和建议的依据。第四部分，国外高校教师民主参与大学管理之比较与借鉴。本部分通过对德国、法国、美国、英国、日本五个国家高校教师民主参与大学管理的历史发展与实施途径的比较，为本研究提出我国高校教师民主参与大学管理的实施策略提供有力的借鉴。第五部分，保障我国公立高校教师民主管理权实施的策略。本部分以明确高校教师角色定位为切入点，提出提高高校教师参与民主管理的建议，从而进一步提出拓展高校教师参与民主管理的实现途径，加强我国高校委员会建设和高校教代会、监事会制度等措施，保障我国公立高校教师民主管理权实施的具体策略。
[Abstract]:The protection of university teachers' rights is a hot and core issue in the theoretical circle of higher education, but the democratic management right of university teachers is seldom studied in depth. The relationship between university teachers and universities has changed, the role of university teachers is vague, and the legitimate rights of university teachers cannot be guaranteed. Based on the above reasons, this study revolves around the content of university teachers' democratic participation in university management. College teachers want to participate in university management and actual participation degree and other aspects of the question, using questionnaire and interview method to investigate the teachers of ten public universities in China, and find out the reasons why the democratic management rights of university teachers can not be implemented. This paper puts forward some strategies to guarantee the democratic participation of public university teachers in university management. This study consists of six parts:. The first part, introduction, gives a general account of the origin of this study, introduces the background, purpose and significance of this study, the definition of related concepts, literature review, research methods and ideas, among which, in the literature review, This paper summarizes the protection of teachers' rights and the democratic management right of university teachers, and clarifies the theoretical value and practical significance of this study. Part two, The basic content and legal basis of the participation of university teachers in democratic management of universities in our country. This part mainly expounds the contents of the participation of university teachers in democratic management of universities and the legal basis of the right of democratic management of university teachers in our country. It lays a theoretical foundation for further research. The third part is the investigation and analysis of the status quo of the implementation of the democratic management right of the public university teachers in our country. This part analyzes the status quo of the implementation of the democratic management right of the public university teachers in our country through the first-hand materials obtained by the questionnaire survey and the chart analysis. To find out the problems and reasons of implementing the democratic management right of teachers in public colleges and universities in our country, and to take this as the basis to put forward the countermeasures and suggestions. Part 4th, comparison and reference of democratic participation in university management by foreign university teachers. This part compares the historical development and implementation of democratic participation in university management in Germany, France, the United States, the United Kingdom, Japan, and five countries, such as Germany, France, the United States, the United Kingdom and Japan. This study provides a powerful reference for the implementation strategy of democratic participation of college teachers in university management in China. Part 5th, the strategy of ensuring the democratic management right of public university teachers in our country. This part puts forward some suggestions on how to improve the participation of university teachers in democratic management by defining the role of teachers in colleges and universities. Further more, the paper puts forward some measures such as expanding the way of university teachers' participation in democratic management, strengthening the construction of university committee, the system of university representative meeting and the system of supervisory board, and so on, so as to ensure the concrete strategy of implementing democratic management right of teachers in public colleges and universities in our country.
