法理视野下高等教育公平问题研究

【摘要】：当今世界各国的综合国力竞争愈演愈烈，国际格局发生着重大变化。教育与经济和政治相互交融、渗透，这既是综合国力竞争的一种基本现实，又是各国捍卫和实现国家利益的一个重大战略。中国自90年代起，高等教育已经逐渐地走上了市场化、规模化的道路，这给中国的高等教育带来了积极的作用，高等教育入学率因此大大提高了，但其消极作用也不可忽视，市场化带来了一些社会不公或称“高教不公”的问题。教育公平不仅仅是完善法律体系上的问题，其更深层次的意义是对社会分层和社会流动的作用。教育的公平直指社会流动的平等状态。高等教育，尤其是精英学校所含有的种种关系、状态和性质，在代际流动中深刻的通过权力场域的形式表现出来。在社会的平等装袋的成因中，教育平等与社会选择和流动有着核心联系，因此权力场域中的高等教育乃至其中蕴含的知识和文化所形成的资本对个人和社会有着不可估量的作用。高等教育法保障下的教育公平，将直接带来社会的公平，影响着文化资本在分配、占有、继承和流转中的公平。所以，通过对高等教育公平问题的研究，寻求保护各阶层，特别是处于不利地位的社会阶层的合法权益，使不同人群都拥有同等的受教育权以及发展的方向。尤其是在社会发展新时期中，在更为崇尚以人为本的社会意识下，对高等教育公平的研究意义就更为深远了。社会经济的发展，特别是教育改革和发展的不断深入，呼唤着高等教育法的改革和完善，包括教育公平理论的不断创新，这已经在一定程度上成为了当前教育改革和发展中的重大理论与实践课题。本文把对高等教育公平问题的研究放在法学理论的研究视阈中，以法学的核心价值观为切入点，，透过现象剖析本质，尝试从根源寻求解决高等教育不公平的路径，提出一系列彰显高等教育公平的可行性建议，从而进一步丰富我国高等教育的理论研究。
[Abstract]:Nowadays, the competition of the comprehensive national strength of various countries in the world is becoming more and more intense, and the international pattern is undergoing great changes. Education, economy and politics are intermingled and permeated, which is not only a basic reality of the competition of comprehensive national strength, Since 90s, China's higher education has gradually embarked on the road of marketization and scale, which has brought positive effects to China's higher education. As a result, the enrollment rate of higher education has been greatly increased, but its negative effect should not be ignored. The marketization has brought some social injustice or "higher education injustice". Educational fairness is not only a matter of perfecting the legal system, but also the function of social stratification and social mobility. The equity of education directly refers to the equal state of social mobility. In particular, the relationship, state and nature of elite schools are deeply expressed in the form of power field in intergenerational mobility. In the cause of social equal bagging, the equality of education is closely related to the choice and flow of society. Therefore, the higher education in the field of power and the capital formed by the knowledge and culture contained therein have an inestimable effect on the individual and the society. The educational fairness guaranteed by the higher education law will directly bring about the social equity. It affects the fairness of cultural capital in distribution, possession, inheritance and circulation. Therefore, by studying the issue of equity in higher education, we seek to protect the legitimate rights and interests of all strata, especially the disadvantaged social strata. Especially in the new period of social development, under the social consciousness of advocating humanism, the research significance of the equity of higher education is more far-reaching. The development of social economy, especially the deepening of educational reform and development, calls for the reform and perfection of higher education law, including the innovation of educational equity theory. To a certain extent, this has become an important theoretical and practical subject in the current educational reform and development. This paper puts the research on the equity of higher education in the perspective of the legal theory, taking the core values of the law as the breakthrough point. Through the analysis of the essence of the phenomenon, this paper tries to find a way to solve the unfairness of higher education from the root, and puts forward a series of feasible suggestions to highlight the fairness of higher education, thus further enriching the theoretical research of higher education in China.
