【摘要】:党委领导下的校长负责制是一个比较理想的领导体制,但是在实施过程中由于领导的职责范围划分不清,权力与责任容易失衡,,最终导致教育腐败。高校领导问责制有利于提高高校领导者的责任感,有助于增强公众的监督意识。尽管高校领导问责制在研究和推行的过程中取得了一定的成果,然而对于具体教育领域内高校领导问责还没有成文的规定,导致高校领导问责制成为一纸空文。本研究试图通过对我国高校领导问责制的必要性和现实困境分析,从领导问责主体、问责对象、问责行为、问责范围、问责后果、问责机构、问责程序、问责救济八个逻辑范畴构建出我国高校领导问责制法律体系。本文主要由四部分构成: 第一章,引言。主要介绍了问题提出的背景、研究目的、研究意义、研究内容、文献综述和研究方法。 第二章,高校领导问责制的相关理论概述。一是基本概念的界定,主要包括问责制、高校问责制和高校领导问责制;二是相关理论综述,包括人民主权理论、权责统一理论和程序法治理论。 第三章,实施我国高校领导问责制的必要性及现实困境分析。首先提出建立高校领导问责制度的必要性:高校领导问责制现实性需求、依法治教的迫切需要、提高高等教育管理效益的内在要求、改善中国高校领导政治生态的重要内容、借鉴国外高校问责的成功经验的必要性;其次从我国高校领导问责发展现状和问题两个方面总结分析我国高校领导问责制的现实困境。高校领导问责制在我国所赖以形成的土壤还不成熟,思考我国现阶段的实际情况,说明在“党委领导下的校长负责制”的模式中,并不存在着真正的高校领导问责机制,从而表明构建高校领导问责制的必要性和紧迫性。 第四章,完善我国高校领导问责制的对策。提出实施高校领导问责制所应坚持的基本原则;通过国外经验的借鉴和相关文献的分析与思考、结合我国的具体国情,提出改进建议,从领导问责主体、问责对象、问责行为、问责范围、问责后果、问责机构、问责程序、问责救济构建出适合我国国情的高校领导问责制法律体系,探索与高校领导问责制相配套的理念以及法律制度实施保障。
[Abstract]:The principal responsibility system under the leadership of the Party committee is an ideal leadership system, but in the process of implementation, due to the unclear division of the responsibilities of the leaders, power and responsibility are easily out of balance, leading to education corruption. The accountability system of university leaders is helpful to enhance the sense of responsibility of university leaders and enhance the public's consciousness of supervision. Although some achievements have been made in the research and implementation of the leadership accountability system in colleges and universities, there is no written provision for the accountability of university leaders in the specific field of education, which leads to the accountability system of university leaders becoming a dead letter. This study attempts to analyze the necessity and realistic predicament of the leadership accountability system in colleges and universities in China, from the leadership accountability subject, the accountability object, the accountability behavior, the accountability scope, the accountability consequence, the accountability institution, the accountability procedure. The eight logical categories of accountability remedy construct the legal system of leadership accountability system in colleges and universities in China. This paper consists of four parts: Chapter one, introduction. This paper mainly introduces the background, purpose, significance, content, literature review and research methods of the problem. The second chapter is an overview of the relevant theories of leadership accountability in colleges and universities. One is the definition of basic concepts, including the accountability system, the university accountability system and the leadership accountability system, and the other is the summary of relevant theories, including the theory of people's sovereignty, the unified theory of power and responsibility and the theory of rule of law by procedure. The third chapter analyzes the necessity and realistic predicament of implementing the leadership accountability system in colleges and universities in China. First of all, the paper puts forward the necessity of establishing the system of leadership accountability system in colleges and universities: the realistic demand of leadership accountability system in colleges and universities, the urgent need of administering education according to law, the internal requirements of improving the efficiency of higher education management, and the important content of improving the political ecology of Chinese university leaders. It is necessary to draw lessons from the successful experiences of foreign universities and colleges, and then summarize and analyze the realistic predicament of the leadership accountability system in our country from two aspects: the present situation and the problems of the development of leadership accountability in our country's colleges and universities. The soil on which the accountability system of university leaders is formed in our country is still immature. Considering the actual situation of our country at the present stage, we can see that there is no real mechanism of leadership accountability in the mode of "President responsibility system under the leadership of Party Committee". Therefore, it shows the necessity and urgency of constructing leadership accountability system in colleges and universities. The fourth chapter, consummates our country university leadership accountability system countermeasure. This paper puts forward the basic principles to be adhered to in the implementation of the leadership accountability system in colleges and universities, through the analysis and reflection of foreign experiences and relevant literature, and combining with the specific conditions of our country, puts forward some suggestions for improvement, including leadership accountability subject, accountability object, accountability behavior, and so on. The scope of accountability, the consequences of accountability, accountability institutions, accountability procedures, accountability relief to build a suitable legal system for our country's leadership accountability system, explore the concept of matching with the university leadership accountability system and the implementation of the legal system protection.
