法制视野下的大学生思想道德问题探究

【摘要】：近年来，随着信息、科技、文化等要素的快速发展，高校大学生的道德观念和法律意识发生了诸多变化，受西方各种社会思潮、价值观念、社会结构和利益关系等因素影响，，大学生道德滑坡、违法犯罪现象时有发生，大学生的心理和思想层面出现了诸多问题。因此，学术界对于大学生思想道德问题给予了长期的关注，回顾文献发现，以往的研究中关于高校思想道德教育问题方面的研究，或偏重德育，或偏重法制教育，德育与法制教育的脱节或衔接不够，使得研究问题的深刻性不足，所提对策的操作性不强。笔者认为，当道德谴责已经不能阻止当代大学生因道德缺失而做出的违法犯罪行为时，高校应当加强法制教育与大学生思想道德教育的有机结合，使大学生通过对基本法律知识的学习来培养自己的法制观念和法律素养，规范自己的道德行为，进而提高自身思想道德修养。本文从法制视野下的大学生思想道德问题研究的必要性与可行性出发，在对大学生思想道德现状以及问题产生的原因深入分析后，给出了法制视野下加强大学生思想道德修养的途径与方法。强调法制与道德的有机统一，把精神文明关于思想品德的要求转化为一种行为习惯，把道德规范从法律的强制性约束转化为自觉的道德修养，是改善大学生思想道德状况的良策。大学生作为民族的希望和祖国的未来，提高他们的道德素质，对培养守法公民，建设社会主义法治国家和实施“依法治国”方略等方面具有重大的战略意义，为中国特色社会主义法律体系的形成起到有力的推动作用。
[Abstract]:In recent years, with the rapid development of information, science and technology, culture and other elements, many changes have taken place in the moral and legal consciousness of college students, which are influenced by various social trends of thought, values, social structure and interest relations in the West. The moral decline of college students, the phenomenon of illegal crime occur from time to time, the psychological and ideological level of college students have many problems. Therefore, academic circles have paid a long attention to the ideological and moral problems of college students. Review the literature and find that the previous researches on the ideological and moral education in colleges and universities have focused on moral education, or on legal education. The disconnection between moral education and legal education is not enough, which makes the research problem deep enough, and the operation of the proposed countermeasures is not strong. The author believes that when moral condemnation can no longer prevent contemporary college students from committing illegal and criminal acts because of lack of morality, colleges and universities should strengthen the organic combination of legal education and ideological and moral education of college students. Through the study of basic legal knowledge, college students can cultivate their own legal concept and legal literacy, standardize their own moral behavior, and then improve their ideological and moral accomplishment. Starting from the necessity and feasibility of the research on the ideological and moral problems of college students under the legal system, this paper makes a thorough analysis of the present situation of college students' ideology and morality and the causes of the problems. This paper gives the ways and methods of strengthening the ideological and moral cultivation of college students from the perspective of legal system. Emphasizing the organic unity of the legal system and morality, transforming the requirements of spiritual civilization on ideological and moral character into a behavior habit, and transforming the moral standard from the compulsory restraint of the law into a conscious moral accomplishment, It is a good strategy to improve the ideological and moral situation of college students. The hope of college students as a nation and the future of the motherland, to improve their moral quality, is of great strategic significance in cultivating law-abiding citizens, building a socialist country ruled by law and implementing the strategy of "governing the country according to law". For the formation of the socialist legal system with Chinese characteristics play a role in promoting.
