论校园暴力防治——以分层处理、分化处理和分类处理制度为视角

【摘要】：近年来,一些发生在青少年学生之间的影响恶劣的校园暴力事件被频繁报道,甚至部分施暴视频被上传至网络大量传播,将校园暴力的低龄化、成人化、残忍化的一面直接暴露在成人社会的视野,引发了社会的高度关注和担忧,甚至导致部分民众认为《未成年人保护法》成为了纵容未成年人犯罪保护伞的质疑。校园暴力作为一个复杂的社会现象,在面对、处理时,既应该坚持教育为主、惩罚为辅的原则,同时要正视校园暴力案事例处理中家庭和学校教育的失调和校园暴力的严重危害性,有必要引入家庭、学校、司法形成全社会的合力和建立分层、分类、分化处理的全方位防治制度。
[Abstract]:In recent years, some violent incidents of campus violence that occur among teenagers and students have been frequently reported, and even some of the violent videos have been uploaded to the Internet in large numbers, making the younger age of campus violence more adult. The cruel side is directly exposed to the vision of the adult society, which has aroused the high concern and worry of the society, and even led some people to think that the Law on Protection of minors has become the umbrella for conniving juvenile delinquency. School violence as a complex social phenomenon, in the face of, when dealing with, should not only adhere to the principle of education, supplemented by punishment, At the same time, in order to face up to the maladjustment of family and school education and the serious harmfulness of school violence in dealing with cases of school violence, it is necessary to introduce family, school, and justice to form the resultant force of the whole society and to establish stratification and classification.
