我国学前教育地方立法的现实困境及其改进方向

【摘要】:学前教育作为终身教育的开端,立法保障是促进其健康有序发展的前提。我国学前教育地方立法是地方人大和地方政府密切关注的重点,也是改善民生的一项重要内容。通过对当前我国学前教育地方立法现状的考察,有关学前教育地方立法的数量呈现"东多西少"的态势、同一地区的学前教育地方立法存在失当之处、权利义务关系配置缺位以及实质性内容条款较为模糊且操作性不强等现实困境。为此,着力提升学前教育地方立法技术,厘定学前教育各地方主体间的权利义务边界,建立学前教育地方办园监督问责机制等,应成为未来学前教育地方立法改进的主攻方向。
[Abstract]:Preschool education as the beginning of lifelong education, legislative protection is the premise to promote its healthy and orderly development. The local legislation of preschool education is the focus of attention of local people's Congress and local government, and also an important content of improving people's livelihood. Through the investigation of the current situation of local legislation on preschool education in our country, the quantity of local legislation on preschool education presents the trend of "east more than west less", and the local legislation of preschool education in the same area has some missteps. Rights and obligations of the relationship between the allocation of the absence and substantive content terms are vague and not operational and other practical dilemmas. Therefore, to improve the local legislation technology of preschool education, to determine the boundary of rights and obligations among the local subjects of preschool education, and to establish the mechanism of local supervision and accountability of preschool education should become the main direction of the improvement of local legislation of preschool education in the future.
