中等职业学校法制教育存在的问题与有效对策

【摘要】:随着我国改革开放,,社会主义现代化建设事业的不断推进,中等职业教育所培养的适应现代社会需要的,拥有中级专业技能的实用型劳动者成为了社会生产力的中坚力量。但近年来我国中等职业学校学生的现状令人担忧,生源整体质量下滑严重,学生法制意识薄弱,不良违纪违法行为屡禁不止,这种状况既不利于学生自身的健康成长,也会给社会发展带来一定的负面影响。我们不禁会思考,为什么会出现目前这种状况?客观上说是有很多因素造成的,但从学校教育角度讲,这与当前我国各类中职学校法制教育缺乏针对性、实效性的措施有很大关系。如何有效地在中等职业学校开展法制教育,帮助学生正确地树立法制观念,培养法律意识,为将来依法进行职业生涯活动打下坚实的基础,已成为社会、学校、家庭共同关注的话题,也成为中职学校提高法制教育效果急需解决的问题。 本文对当地几所中职学校进行了问卷调查和访谈,并走访了当地的部分检察机关。通过调查,笔者发现当前我国中等职业学校法制教育主要存在以下问题:如中职学校对法制教育重视不够,重心偏移,教育计划存在着一定的不合理成分;法制课教师专业水平参差不齐、教学方法单一,教学效果较差,使得学校法制教育主阵地作用难以很好地发挥;学生“重专业轻法律”风气浓厚,对法制课学习积极性不高;家庭、社会等外部环境对中职学校法制教育还存在着一定的负面影响,加之各方面对法制教育的监管力度不够等。这些问题的存在已严重地影响了目前许多中职学校培养目标的实现和学生个人的成才。如何解决这一问题成为中职学校法制教育无法回避的一个难题。在这方面国内外一些专家和学者都在进行了积极地探索和研究,并积累了一定的经验。例如,在英国,学校会依照年龄将学生分为两个阶段,针对每个阶段学生的不同特点,开展相应的法制教育活动,以保证法制教育的有效性;美国的学校法制教育则更强调与实践的有机结合,学校通过与司法机关、律师事务所以及社区的合作,让学生的法制素养在实践中得以提升。这些成果对于我们分析和解决目前的这一难题具有一定的现实意义。纵览国内外研究成果,结合我国中职学校法制教育的实际,本人认为中职学校应从健全法制教育课程体系、创新法制教育模式、提高法制教师整体专业素质、营造良好育人环境以及建立有效的监督、评价、反馈机制等方面进行改进,以期提高我国中职学校法制教育水平并为其在新时期的发展提供一些新的思路。
[Abstract]:With the reform and opening up of our country and the advancement of the socialist modernization construction, the practical workers trained by the secondary vocational education to meet the needs of the modern society and have intermediate professional skills have become the backbone of the social productive forces. However, in recent years, the current situation of students in secondary vocational schools in China is worrying, the overall quality of students has declined seriously, students' legal consciousness is weak, and the bad and illegal activities are repeatedly prohibited. This situation is not conducive to the healthy growth of the students themselves. Also can bring certain negative influence to the social development. We can't help wondering why this is happening. Objectively speaking, there are many factors, but from the point of view of school education, this is related to the lack of pertinence and effective measures of legal education in various secondary vocational schools in our country at present. How to effectively carry out legal education in secondary vocational schools, help students to set up the concept of legal system correctly, cultivate legal consciousness, lay a solid foundation for carrying out professional career activities according to law in the future, has become the society and school, The topic that family pays attention to together, also become the problem that secondary vocational school raises legal system education effect urgently to solve. In this paper, some local secondary vocational schools were investigated and interviewed, and some local procuratorial organs were visited. Through the investigation, the author finds that there are the following problems in the legal education of the secondary vocational schools: the secondary vocational schools pay less attention to the legal education, the center of gravity is shifted, and there are some unreasonable elements in the education plan; The professional level of legal teachers is uneven, the teaching method is single, and the teaching effect is poor, which makes it difficult to give full play to the main position of the legal education in schools, and the students pay more attention to the specialty than the law, so they are not enthusiastic about the study of the legal course. The external environment such as family and society also has some negative effects on the legal education of secondary vocational schools, in addition, the supervision of legal education in all aspects is not enough. The existence of these problems has seriously affected the realization of the training goals of many secondary vocational schools and the individual talents of students. How to solve this problem has become an unavoidable problem in the legal education of secondary vocational schools. In this respect, some experts and scholars at home and abroad have actively explored and studied, and accumulated some experience. For example, in the United Kingdom, schools divide students into two stages according to their age. According to the different characteristics of students in each stage, they carry out corresponding legal education activities in order to ensure the effectiveness of legal education. The school legal education in the United States emphasizes the organic combination with practice. Through the cooperation with the judiciary, law firms and the community, the students' legal literacy can be improved in practice. These results have certain practical significance for us to analyze and solve this difficult problem. By reviewing the research results at home and abroad and combining with the reality of legal education in secondary vocational schools in China, I believe that secondary vocational schools should improve the legal education curriculum system, innovate the legal education model, and improve the overall professional quality of legal teachers. In order to improve the level of legal education in secondary vocational schools and provide some new ideas for the development of secondary vocational schools in the new period, we should build a good educational environment and establish effective supervision, evaluation, feedback mechanism and so on.
