【摘要】:近年来,绿色发展理念引导我国生态建设不断向前推进,生态要素也越来越成为重要的生产要素。由于我国生态脆弱地区面积广泛且与经济落后地区高度重合,同时这些地区发展还均受制于开发和保护矛盾的约束,实践表明,解决这种矛盾问题单靠政府财政资金的投入远不能及。因此,在生态治理实践的倒逼下,我国迫切需要进行生态资源资产的产权制度改革,并推动生态资源资产产权交易机制的建立和完善。从融资角度看,企业作为社会资本的主力,具有资金、技术、人才等巨大优势,一旦其自发参与生态资源资产产权交易的意愿被激发,我国生态补偿因融资短缺而进展缓慢的窘境也必能得到缓解。鉴于此,本文通过梳理国内外研究成果和实践经验,运用生态资源和产权等相关基础理论,借鉴国内农村产权、公共资源产权等市场交易机制构建的经验,拟从企业视角对生态资源资产产权交易机制的构建展开研究和探讨。虽然目前我国缺乏对生态资源资产产权交易的系统性制度规制,但各地区机构已开始结合自身条件,尝试对农地资源、水资源等生态资源资产的产权交易机制进行建设和运行。本文通过案例资料分析及运行情况梳理,发现顶层制度及配套细则缺失、政府角色扮演混乱复杂、进场交易品种单一、专业性中介机构发展滞后、产权交易信息披露不完善是现行各类生态资源资产产权交易机制主要的共性问题,其不仅阻碍了生态资源资产产权交易发展的进度,还抑制了企业等社会资本参与其中的积极性。因此,本文从企业视角出发,从宏观和微观两个层面研究生态资源资产产权交易机制,不仅提出顶层制度设计时需要着重考虑的问题,还对包括交易市场、交易规则等内容在内的微观机制进行探讨,尝试构建有别于公共资源交易市场、企业产权交易市场的新型产权交易市场——生态资源资产产权交易市场。最后,本文从进一步完善生态资源资产产权制度等三个方面提出十一项政策建议,以期通过激发企业等社会资本主力参与意愿,促进生态资源资产产权交易平台构建,并加速全国统一市场的形成,在拓宽横向生态补偿资金融通渠道的同时,也为解决生态脆弱地区亟需生态修复而又面临经济发展滞后的矛盾性问题提供政策出路。
[Abstract]:In recent years, the concept of green development has led the ecological construction of our country to move forward, and ecological elements have become more and more important factors of production. Because the ecological fragile areas in China are extensive and highly coincide with the economically backward areas. At the same time, the development of these areas are also constrained by the contradiction of development and protection. The practice shows that the solution of this contradiction is far from enough by the investment of government financial funds alone. Therefore, it is forced by the practice of ecological governance. China urgently needs to reform the property right system of ecological resources assets and promote the establishment and improvement of property rights trading mechanism of ecological resources assets. From the perspective of financing, enterprises, as the main force of social capital, have funds. Technology, talent and other huge advantages, once its spontaneous participation in the property rights transaction of ecological resources assets is motivated, our ecological compensation due to the shortage of financing and slow progress will be alleviated. In view of this. Through combing the domestic and foreign research results and practical experience, using the ecological resources and property rights and other related basic theory, using the domestic rural property rights, public resources property rights and other market transaction mechanism construction experience. This paper intends to study and discuss the construction of property rights trading mechanism of ecological resources assets from the perspective of enterprises, although there is a lack of systematic institutional regulation on property rights transactions of ecological resources assets in China at present. However, the regional institutions have begun to combine their own conditions, try to land resources, water resources and other ecological resources assets of property rights trading mechanism construction and operation. Found that the top level of the system and the lack of supporting rules, government role play chaos and complexity, enter the market transactions of a single variety, professional intermediary institutions lag behind. The imperfect disclosure of property rights transaction information is the main common problem in the property right trading mechanism of various kinds of ecological resources assets, which not only hinders the progress of property rights transaction of ecological resources assets. It also inhibits the enthusiasm of enterprises and other social capital to participate in it. Therefore, this paper studies the transaction mechanism of property rights of ecological resources assets from the perspective of enterprises, from the macro and micro levels. Not only put forward the top-level system design need to focus on the issues, but also to the transaction market, trading rules and other aspects of the micro-mechanism, trying to build a different from the public resource trading market. Finally, this paper puts forward eleven policy suggestions from three aspects of further perfecting the property right system of ecological resources assets. In order to stimulate enterprises and other social capital to participate in the main willingness to promote the construction of property rights trading platform for ecological resources assets and accelerate the formation of a unified national market while widening the horizontal channels of ecological compensation funds financing. It also provides a policy outlet for solving the contradiction of ecological restoration in fragile ecological areas and the lag of economic development.
