【摘要】:一项工程项目从开始到结束,可以分为若干阶段,这些紧密联系的阶段构成一项工程的生命期。从大体上看,可以分为四个阶段,分别是启动阶段,规划阶段,实施阶段和收尾阶段。对项目的管理需要开展一系列的活动,包括项目计划、决策、沟通、协调和控制等等。合同贯穿在工程项目建设的始终,并逐渐成为工程开发商和承包商进行工程施工的主要依据。在工程项目施工合同的内容变得更为复杂、详尽的同时,合同风险问题也越来越突出。风险是客观存在的,而且是一把双刃剑,它会给我们带来一定的机遇,同时也会带来一定的损失。特别是随着我国由社会主义计划经济体制向社会主义市场经济体制的不断深化,人们的风险意识逐渐增强,如何能够更好地利用风险、降低风险系数、用最小的投入控制风险获取依然是我们必须要面临的重大课题。合同是工程项目实施和管理的重要手段和工具,工程在建设过程中需要签订一系列的工程施工合同,并在施工过程中要遵守合同的约定,按照合同要求履行合同内容。随着我国法制体系建设的不断完善,按合同的约定来判断权责是非已成为社会发展的必然趋势。工程施工合同存在着诸多问题,这不仅会造成工程的严重拖期、进度的滞后,最为重要的是会导致本来盈利的工程盈利水平会降低,甚至出现亏损。工程项目的合同主要包括标的合同,总包合同,专业分包合同,采购合同,设计合同等等。在这些合同中,建设单位能够如何把握风险,并及时进行风险管理,保证工程建设的进度,是本文所要解决的重要问题。S医院工程建设项目建成后将成为盘锦辽滨沿海经济区标志性建筑之一,努力打造具有国际一流水平的健康中心,其投资规模大、建设周期较长、涉及的合同主体也较为复杂。所以在项目施工建设的过程中加强对合同及其风险的管理,是S医院项目建设的的一项重要工作。根据项目合同风险控制和管理的相关理论、方法,与S医院项目建设的合同风险管理实际相结合,针对存在的问题以期对风险管理进行改善。本篇论文共分为五个部分。绪论部分是对本篇论文的研究背景的介绍,包括工程项目建设合同风险管理问题的研究意义、本文的研究背景以及当前国内外研究现状的总体概括。第二部分工程项目合同风险管理的相关理论,主要包括工程项目合同的种类、主要内容以及风险的产生和特征,项目工程合同与风险之间的等。第三部分是对S医院工程项目的概述并对合同管理存在的问题及成因进行了分析。第四部分是对S医院工程项目风险因素的识别和评价。第五部分是S医院工程项目合同风险管理的改善方案,包括对合同风险控制措施、规避措施以及应对措施。最后是对S医院工程项目合同风险管理的总结以及对合同风险管理的展望。

So the strengthening of contract and risk management in the process of project construction, is an important work of S hospital construction projects. According to the theory, control and management of project contract risk method, combined with the contract risk management of S hospital project construction practice, aiming at the existing problems in order to improve risk management. This paper is divided into five parts. The introduction part is the research background of this thesis introduces the significance of the research, including the project construction contract risk management problems, the research background of this paper and the overall current study at home and abroad are summarized. The second part of the project with the relevant theory of risk management, the main types include the project contract, and the main contents and characteristics of risk, between the project contract and risk. The third part is the S hospital project overview and analysis of contract management problems and causes. The fourth part is the identification and evaluation of S hospital project risk factors.
