铁岭市电梯公共安全监管存在的问题与对策

【摘要】：电梯随着经济社会的快速发展以及城市化进程的不断推进,在人们生产和生活中的运用越来越广泛,与公众的关系越来越密切。电梯作为建筑物内的垂直运输工具,像其他的交通工具一样,正逐渐改变人们的出行方式。作为城市建筑的中枢神经,电梯起着不可或缺的作用。电梯的大量使用在给人们带来便捷的同时,频繁发生的电梯安全事故,也给公众安全带来了危害。特别是近几年,频繁发生的电梯事故造成很多人员伤亡电梯行业存在的公共安全隐患也逐渐引起人们的关注：到底是什么环节出现了问题。是电梯的质量?还是使用者操作不当?还是政府在监管中出现漏洞?本文通过汲取不同国家和地区在电梯安全监管方面的成功经验,指出铁岭市电梯安全监督管理的不足：包括目前电梯安全监管方面的法律法规不够完善；专业的电梯安全监管人员相对较少；电梯安全监管的模式过于单一,已经和日趋增多的电梯发展不适应；电梯安全监管涉及多个环节,监管部门难以做到全覆盖。通过分析电梯安全监管中出现的问题,深入探究产生不足的根本原因：包括政府监管体制还不完善；安全监察的力量薄弱；电梯维保市场的恶性竞争；公众的电梯安全使用知识相对缺乏。结合铁岭市电梯公共安全监管的现状,提出一些具有针对性以及可行性的建议对策。一是进一步加强法律法规建设。通过制定电梯统一监管的法律法规和完善电梯的安全标准,避免由于电梯安全标准不统一带来的监管混乱；二是适应信息化的发展,在电梯安全监管领域运用物联网等技术,建立电梯应急处置平台,提高电梯安全监管的有效性；三是进一步加强电梯行业的全行业监管。通过创新监管模式,引入专业的第三方监管,有效的克服政府监管人员不足的问题,同时专业的监管可以使监管的过程更加专业化；最后建议在电梯行业引入电梯安全责任险。目的可以在电梯事故发生时,使受伤群众的权益得到最大的保障。
[Abstract]:With the rapid development of economy and society and the development of urbanization, elevators are more and more widely used in people's production and life, and have more and more close relationship with the public. Like other means of transportation, it is gradually changing the way people travel. As the central nervous system of urban buildings, elevators play an indispensable role. The extensive use of elevators not only brings convenience to people, but also brings convenience to people. The frequent elevator safety accidents have also brought harm to public safety. Especially in recent years, The frequent elevator accidents cause a lot of casualties elevator industry public safety hidden danger also gradually aroused people's attention: in the end what is the link problem is the quality of the elevator? Or is the user operating incorrectly? Or is there a loophole in government regulation? By drawing on the successful experiences of different countries and regions in elevator safety supervision, this paper points out the shortcomings of elevator safety supervision and management in Tieling city: including the imperfect laws and regulations of elevator safety supervision at present; There are relatively few professional elevator safety supervisors; the mode of elevator safety supervision is too single and has not been adapted to the increasing number of elevators; elevator safety supervision involves many links. Through the analysis of the problems in elevator safety supervision, this paper explores the root causes of the deficiencies: including the imperfect government supervision system, the weak power of safety supervision; The vicious competition of elevator maintenance market, the relative lack of public knowledge about elevator safety use, combined with the present situation of public safety supervision of elevator in Tieling City, The first is to further strengthen the construction of laws and regulations. By making laws and regulations for unified supervision of elevators and perfecting the safety standards of elevators, The second is to adapt to the development of information, to use the Internet of things technology in the field of elevator safety supervision, to establish the elevator emergency disposal platform, and to improve the effectiveness of elevator safety supervision. The third is to further strengthen the whole industry supervision of elevator industry. Through the innovation of supervision mode, the introduction of professional third party supervision, effectively overcome the shortage of government supervisors, and professional supervision can make the process of supervision more professional; Finally, it is suggested that the elevator safety liability insurance should be introduced in the elevator industry, so that the rights and interests of the injured people can be maximized when the elevator accident occurs.
