住宅小区停车位之权属、收费类型与收费制度研究

【摘要】：住宅小区停车位所有权可能归属开发商、中介公司、全体业主以及个别业主等。倘若以住宅小区停车位权属关系为依据,住宅小区停车位的收费可以划分为市场主导的服务型收费、所有业主主导的协商型收费以及个别业主主导的情感型收费。市场收费制度构建以价值规律为准则,但政府应留意住宅小区停车位收费垄断问题;协商收费制度构建应突出住宅小区业主大会或者委员会的主导作用,但制定收费标准应区别对待;情感收费制度构建属于个人行为,可以上升到法律层面约束,但更应强调伦理道德之制约。
[Abstract]:The ownership of parking spaces in residential areas may belong to the developer, intermediary companies, all owners and individual owners. If the ownership relationship of parking spaces in residential areas is taken as the basis, The fees of parking spaces in residential areas can be divided into market-oriented service charges, all owner-led negotiated fees and individual owner-led emotional charges. The construction of market charge system is based on the law of value. However, the government should pay attention to the monopolization of parking space charges in residential areas, and the construction of negotiation fee system should emphasize the leading role of the owners' meeting or committee in residential quarter, but should be treated differently when the charging standard is formulated. The construction of emotional charge system belongs to individual behavior and can rise to the level of law, but it should emphasize the restriction of ethics and morality.
