原则与例外的统一:“一般基础设施”判断的欧盟实践及对中国的启示

【摘要】:欧盟根据政府资助是否授予接受者不公平的竞争优势区分"一般基础设施"和"特定使用者基础设施",并分别在使用者、所有者/管理者及其股东层面,创设出判断"一般基础设施"的公开使用原则、国家职责原则、公开招投标原则、私人投资者原则和低利润原则。此外,基于协调保护竞争与其他社会目标之间的冲突以及克服市场失灵的现实需要,欧盟委员会又设置了豁免"特定使用者基础设施"的若干例外。中国可借鉴上述原则识别"一般基础设施",并豁免政府向兼具经济不可行性、公共利益性和比例性的"特定使用者基础设施"提供的资助。
[Abstract]:The EU distinguishes between "general infrastructure" and "user-specific infrastructure" according to whether government funding grants unfair competitive advantages to recipients, and at the user, owner / manager and shareholder levels, respectively. Creating the principles of open use of "general infrastructure", principles of State responsibility, open bidding, private investors and low profits. Based on the realistic need to reconcile the conflict between the protection of competition and other social objectives and to overcome market failures, The European Commission has also established a number of exceptions to the exemption of "specific user infrastructure". China can identify "general infrastructure" using the above-mentioned principles and exempt governments from economic infeasibility. Public interest and proportionate funding from "specific user infrastructure".
