【摘要】:随着O2O商业模式的兴起和发展,鉴于网络订餐具有直观形象、互动性强、方便快捷、便于管理等特点,被消费者逐步接受和认可,网络订餐行业迅猛发展。网络订餐在带给消费者快捷便利的同时,因网络订餐食品安全监管滞后,存在诸多隐患。近年来,网络订餐食品安全事件频现于各大新闻媒体,引起社会的广泛关注。现今,我国急需对网络订餐食品安全及其监管进行全面系统地研究,进而为相应法律法规的制定和政府食品安全监管提供坚实的理论基础。当下,我国网络订餐食品安全监管不力,缺乏有效的监管措施,即使现有的监管措施也存在落实不到位的问题;网络订餐第三方平台在技术上和管理上存在漏洞,注册商家审核把关不严,对其违法经营制止不力,甚至包庇其不法行为;相应的法律法规不完善,新修订的《食品安全法》和2016年颁布的《网络食品安全违法行为查处办法》对网络订餐诸多关系界定不清,权责不明;部门间监管不协调,政府部门间以及政府与社会组织、订餐平台间存在监督配合不默契,推诿扯皮等现象;网络订餐的虚拟性及其事前、事中监管的缺失,导致问题食品追溯困难。针对我国网络订餐食品安全监管中存在的诸多问题,要借鉴发达国家在网络订餐食品安全监管方面的成功经验,从多方面着手。一是完善相关的法律法规,网络订餐的各个环节及其主体要有相应的规范,并建立监督、追责制度。二是建立和完善网络订餐主体准入机制,加大入网商户的审查力度,规范第三方平台监管行为。三是建立和完善网络订餐食品安全政府监管协作机制,搭建“互联网+监管”信息平台,确立网格信息化监管模式,建立网络订餐追溯召回体系。四是建立社会组织参与的食品安全监管协作机制,确定网络订餐行业标准,充分发挥媒体及广大消费者的监督作用。食品安全是民生大事,我国政府要建立和完善网络订餐食品安全监管体系,推动网络订餐行业稳步发展,在便民惠民的基础上,切实保障消费者的权益。
[Abstract]:With the rise and development of the O2O business model, the online ordering industry has been gradually accepted and recognized by consumers because of its intuitive image, strong interactive, convenient and convenient management and so on. Internet ordering brings convenience to consumers, and there are many hidden dangers because of the lag of food safety supervision. In recent years, the network ordering food safety incidents frequently appear in the major news media, causing widespread concern. At present, our country urgently needs to carry on the comprehensive and systematic research to the network ordering food safety and its supervision, thus provides the solid theory foundation for the corresponding laws and regulations formulation and the government food safety supervision. At present, China's network food order safety supervision is weak, lack of effective regulatory measures, even the existing regulatory measures also exist in place to implement the problem; online third-party platform in terms of technology and management loopholes, The registered businesses are not strictly checked and guarded, and their illegal operations are not effectively checked, or even their illegal acts are covered up; the corresponding laws and regulations are not perfect, The newly revised "Food Safety Law" and the "measures for investigating and punishing illegal acts of online Food Safety" promulgated in 2016 have unclear definitions of many relationships between online food orders, unclear powers and responsibilities, lack of coordination between departments of supervision and supervision, and between government departments and social organizations. There is not tacit agreement between supervision and cooperation between the platform of ordering meals, prevarication and other phenomena; the fictitious nature of online ordering and the lack of supervision in advance lead to the difficulty of tracing the problem food. In view of many problems existing in the supervision of food safety in our country, we should draw lessons from the successful experiences of the developed countries in the supervision of online food ordering, and start from many aspects. The first is to perfect the relevant laws and regulations, each link and the main body of the network order must have the corresponding standard, and establishes the supervision, the responsibility system. Second, it is necessary to establish and perfect the access mechanism of online ordering subjects, increase the censorship of online merchants, and standardize the supervision of third-party platforms. Third, it is necessary to establish and perfect the cooperative mechanism of government supervision on food safety on the network, build the information platform of "Internet supervision", establish the information supervision mode of grid, and establish the recall system of online food ordering. Fourth, it is necessary to establish a cooperative mechanism of food safety supervision and control with the participation of social organizations, determine the industry standards of online food ordering, and give full play to the supervisory role of the media and consumers. Food safety is a major issue of people's livelihood. Our government should establish and perfect the supervision system of online food ordering, promote the steady development of the online ordering industry, and ensure the rights and interests of consumers on the basis of the convenience of the people.
