基于大部制的地方市场监管体制改革研究

【摘要】：经济新常态下,现代市场经济形势已经发生了重大变化。从当前我国市场监管整体状况来看,安全形势不容乐观,近年来接连发生的食品安全、质量安全、市场秩序等方面的恶性事件,说明传统的市场监管体制和监管模式已经无法适应新的要求。加快体制机制改革,推动政府职能转变和服务型政府建设已经是迫在眉睫。从全国的形势来看,市场监管是政府在经济领域的重要职能之一,加快推进基于大部制的地方市场监管体制改革,推动部门职能转变,建设服务型政府,具有十分重要的意义。基于这种形势,本文以市场监管体制为研究对象,以对“大市场大监管大服务”监管模式的探求为引导,以地方基层为着眼点,运用整体政府的理论和观点,深入探讨“当前市场监管体制存在哪些问题”“基于大部制的市场监管有何优势”“各地市场监管大部制改革实践有何成效和不足”等方面问题。尤其是在当前全国范围内,各地市场监管大部制改革独立探索、各具特点、模式不一的情况下,通过分析部分具有代表性的地区市场监管领域大部制改革的经验和成效,梳理分析总结目前改革仍未解决的问题和遇到的障碍,力求为当前处在探索中的市场监管大部制改革之路找出下一步的努力方向,提出合理化建议。文章首先对市场监管和大部制进行理论分析,阐述市场秩序规制中的市场失灵和市场监管中的政府失灵,得出大部制改革的优势和必要性;其次,归纳我国市场监管体制的演进历程,运用“整体政府理论”分析当前我国市场监管体制存在的问题,并通过对深圳、浙江、天津三个代表地区改革实践的总结,分析了不同改革模式的成果和不足;最后,从改革的深化——“以思路的转变推动体系革新”、保障的强化——“以法制建设和队伍建设夯实监管基础”、措施的优化——“以信用机制和‘大数据+大部制’促进监管升级”、监督的细化——“以广泛的监督参与构建共治格局”四个方面,为下一步改革的努力方向提出详细具体的措施建议。
[Abstract]:Under the new normal state of economy, the situation of modern market economy has changed greatly. Judging from the overall situation of market supervision in our country at present, the safety situation is not optimistic. In recent years, there have been vicious incidents of food safety, quality safety, market order, etc. It shows that the traditional market regulatory system and regulatory model can not adapt to the new requirements. It is urgent to speed up the reform of system and mechanism, to promote the transformation of government functions and the construction of service-oriented government. From the national situation, market supervision is one of the important functions of the government in the economic field. It is of great significance to speed up the reform of the local market supervision system based on the large department system, to promote the transformation of the functions of the departments and to build a service-oriented government. Based on this situation, this paper takes the market supervision system as the research object, takes the exploration of the supervision mode of "big market big supervision and big service" as the guidance, regards the local grassroots as the starting point, applies the whole government's theory and viewpoint. This paper probes into the problems of "what problems exist in the current market supervision system," what are the advantages of the market supervision based on the large department system, "and" what are the achievements and shortcomings in the practice of the reform of the market supervision system in various places ". Especially in the current national scope, the local market supervision system reform independent exploration, each has the characteristic, the pattern is different, through the analysis partial has the representative area market supervision domain big department system reform experience and the result, This paper analyzes and summarizes the unsolved problems and obstacles encountered in the reform at present, and tries to find out the direction of the next step of the reform in the market supervision and management system which is currently under exploration, and puts forward some reasonable suggestions. Firstly, this paper makes a theoretical analysis of market supervision and large department system, expounds the market failure in market order regulation and the government failure in market supervision, and concludes the advantages and necessity of the reform. This paper summarizes the evolution of China's market supervision system, analyzes the problems existing in the current market supervision system by using the "whole government theory", and summarizes the reform practice in Shenzhen, Zhejiang and Tianjin three represents areas. The paper analyzes the achievements and shortcomings of different reform models, and finally, from the deepening of reform, "promoting system innovation with the change of thought", strengthening the guarantee "strengthening the foundation of supervision with the construction of legal system and the construction of team", The optimization of measures-"promoting regulatory upgrading with credit mechanism and big data's large department system", and the refinement of supervision "taking part in the construction of co-governance pattern with extensive supervision" are four aspects. Put forward detailed and concrete measures for the next step of reform.
