国外食品安全社会共治体系的比较与借鉴

【摘要】:食品安全规制是个复杂的社会问题,在规制过程中涉及政府部门、生产者和经营者、行业组织、消费者等多个主体。不同的主体在食品安全治理目标上是一致的,由此可以建立社会共治体系,发挥共治主体的合力。鉴于此,本文通过美国、欧盟食品安全规制的社会共治体系的法律依据和治理主体的职权,分析两个国家和地区在食品安全共治体系上的差异和相同点。进而得出,中国需要发挥政府部门治理主体的合力、推进共治法律体系的规制效应以及引导社会共治多元主体的合作参与。
[Abstract]:Food safety regulation is a complicated social problem, which involves government departments, producers and operators, industry organizations, consumers and so on. Different subjects have the same goal of food safety governance, so they can set up a social co-governance system and exert the resultant force of co-governing subjects. In view of this, this paper analyzes the differences and similarities between the two countries and regions in the food safety co-governance system through the legal basis of the social co-governance system of food safety regulation in the United States and the European Union and the authority of the governing body. Then it is concluded that China needs to bring into play the joint forces of government governance subjects, promote the regulatory effect of co-governance legal system and guide the cooperative participation of social co-governance multiple subjects.
