【摘要】:交强险,即机动车辆交通事故责任强制保险,是我国车险市场的重要险种,也是我国第一个国家立法强制实施的保险制度。保监会发布数据显示,2012年我国交强险承保车辆总数达到1.3亿辆次,保费总收入为1114亿元,全年承担的赔付责任限额为156187亿元,交通事故赔付案共2052万起,各项赔付共为821亿元。可见,交强险在依法保护交通事故受害第三人的赔偿权,维护我国道路交通安全方面发挥了重要作用。 自2006年7月1日交强险制度开始施行以来,我国交强险市场采取“政府定价,保险公司自负盈亏”的经营模式,这种模式具有双重含义:一是要求交强险充分发挥社会救助性的职能,遵循“不盈利不亏损”的经营原则,另一是要求各家保险公司各显神通,在没有任何税收优惠的基础上,自主经营交强险业务,并且自负盈亏。这种模式违背了保险公司的营利本质,其弊端逐渐显现,并已影响了我国交强险市场的健康发展,因此,我国交强险经营模式的改革势在必行。 目前国内学者对交强险的研究主要集中在对其法律制度、费率界定、保险市场现状的探讨上,虽然有部分专家学者提出对现行交强险经营模式的质疑,但缺乏对我国交强险经营模式的系统研究。因此,系统研究我国现有交强险经营模式的内涵、特点及不足,提出适合我国国情的交强险经营模式,对我国交强险的健康发展具有重要的理论和现实意义。 本文在阐述交强险的概念、特征、功能、与商业三者险区别的基础上,结合国际交强险市场的发展现状,比较了我国现行交强险经营模式模式与国际上具有代表性的两种经营模式(市场模式和代办模式)的区别,分析了不同交强险经营模式各自的特点、经营机制及优势,重点分析了我国交强险现有经营模式的特点及逻辑矛盾。最后,结合我国实际,提出了符合我国国情的交强险经营模式,即“政府严格监管下的商业保险公司经营”模式,,以其实现我国交强险市场的健康发展提供理论支持。
[Abstract]:Traffic insurance, that is, compulsory liability insurance for motor vehicle traffic accidents, is an important type of insurance in China's auto insurance market. It is also the first national legislation to enforce the insurance system. According to the data released by the Insurance Regulatory Commission, in 2012, the total number of vehicles insured by traffic insurance in China reached 130 million, the total premium income was 111.4 billion yuan, and the compensation liability limit for the whole year was fifteen trillion six hundred and eighteen billion seven hundred million yuan. There are 20.52 million cases of compensation for traffic accidents, and the total compensation payment is 82.1 billion yuan. It can be seen that traffic insurance plays an important role in protecting the compensation rights of the third party who is injured in traffic accidents according to law and in maintaining the road traffic safety in our country. Since the implementation of the traffic insurance system in July 1st 2006, China's traffic insurance market has adopted the business model of "government pricing, insurance companies are responsible for their own profits and losses". This model has two meanings: one is to require the traffic insurance to give full play to the function of social assistance, to follow the "no profit, no loss" operating principle, the other is to require insurance companies to show their own talents, on the basis of no tax preference. This mode violates the profit nature of the insurance company, and its malpractice gradually appears, and has affected the healthy development of the traffic insurance market in our country, therefore, this mode is contrary to the nature of profit of the insurance company, and has affected the healthy development of the traffic insurance market in our country. It is imperative to reform the management mode of traffic insurance in China. At present, the domestic scholars mainly focus on the legal system, the definition of the rate, the current situation of the insurance market, although some experts and scholars have raised doubts about the current operation mode of the traffic insurance. However, there is a lack of systematic research on the management mode of strong traffic insurance in China. Therefore, the connotation, characteristics and shortcomings of the existing traffic insurance management model are systematically studied, and the operating mode of traffic strong insurance suitable for the national conditions of our country is put forward. It has important theoretical and practical significance for the healthy development of traffic insurance in China. On the basis of expounding the concept, characteristics, functions and differences between commercial and commercial insurance, this paper combines the current situation of the development of the international traffic insurance market. This paper compares the difference between the current trade insurance management model of our country and the two representative international business models (market model and agency mode), and analyzes the characteristics, management mechanism and advantages of different trade strong insurance management models. This paper mainly analyzes the characteristics and logical contradiction of the existing management mode of traffic insurance in China. Finally, combined with the reality of our country, this paper puts forward the management mode of traffic strong insurance, that is, "commercial insurance company management under strict supervision by the government", which is in line with the national conditions of our country. To achieve the healthy development of China's traffic insurance market to provide theoretical support.
