保险产品创新的知识产权保护:原理、实践与改进建议

【摘要】：近年来,我国保险业快速发展,但保险产品创新不足的问题仍然比较突出。加强保险产品创新的知识产权保护,是鼓励保险公司开展产品和服务创新、推动保险业可持续发展的客观要求。从国外经验来看,保险产品除可以享有知识产权法律规定的各项传统权利之外,还可以申请商业方法专利。从国内实践来看,保险产品的著作权保护、商标保护、专利保护和商业秘密保护各有优缺点,但专利保护的力度最大,其重要性也逐步提高。强化我国保险产品创新的知识产权保护,应提高全社会的知识产权保护意识,鼓励国内保险企业加快产品创新;完善知识产权立法,适时推出商业方法专利;采用多种有效手段,加强保险产品创新的行政保护。
[Abstract]:In recent years, China's insurance industry has developed rapidly, but the problem of insufficient innovation of insurance products is still prominent. Strengthening the intellectual property protection of insurance product innovation is the objective requirement to encourage insurance companies to carry out product and service innovation and promote the sustainable development of insurance industry. From the experience of foreign countries, insurance products can not only enjoy the traditional rights stipulated by intellectual property law, but also apply for business method patents. From the domestic practice, the copyright protection, trademark protection, patent protection and trade secret protection of insurance products each have advantages and disadvantages, but the intensity of patent protection is the greatest, and its importance is gradually improved. To strengthen the intellectual property protection of the innovation of insurance products in China, we should improve the consciousness of intellectual property protection in the whole society, encourage the domestic insurance enterprises to speed up the product innovation, perfect the legislation of intellectual property, and introduce the patent of business methods in good time. Adopt a variety of effective means to strengthen the administrative protection of innovation of insurance products.
