产品责任保险及其对我国出口企业的影响分析

【摘要】：由于政策、监管等原因，我国的产品责任保险发展缓慢。实际上，，产品责任保险，尤其是针对出口商品的产品责任保险，在我国仍属于一个尚未完全开发的保险领域。实践中，由产品缺陷而引发诉讼甚至高额赔偿时有发生，影响了企业的正常生产与经营。随着产品责任赔偿金额的增加以及产品责任风险的加大，社会对产品责任保险的认识与需求也将随之加大。因此，系统地研究产品责任保险进行显得十分必要。本文将从法律制度、公民法律意识等方面对我国的产品责任保险及其对出口企业乃至对社会经济的影响进行探讨。全文共分七个部分。第文章的一部分为绪论。第二部分介绍产品责任保险的理论基础，阐述产品责任保险的概念、功能以及与一般财产保险、信用保险的区别。第三部分分析我国产品责任保险的发展现状及其存在问题，阐述产品责任保险对我国出口企业健康发展的重要意义，说明法律制度和人们对保险的认识是影响我国的产品责任保险尤其是出口产品责任保险发展的重要因素。第四部分，作为借鉴，介绍和分析美国和欧盟产品责任及其法律制度的产生与发展。第五部分分析出口产品责任保险对我国的出口企业和对外贸易的影响，表明出口产品责任保险是保证国出口企业生产经营稳定的重要保障，也是保证我国经济增长的一个重要方面。第六部分基于前述各部分的分析，从完善法律制度、提高保险意识以及人才培养、保险管理等方面提出建议与对策。最后，第七部分，是文章的结论与展望。健全产品责任及相关法律制度以及提高社会的风险与保险意识，应是当前和今后较长时期的重要任务。随着社会的进步和经济的发展，产品责任保险必将得到长足的发展。产品责任保险一定是财产保险的一个重要增长点。
[Abstract]:Due to policy, supervision and other reasons, China's product liability insurance development is slow. In fact, product liability insurance, especially the product liability insurance for export commodities, still belongs to an insurance field that has not been fully developed in China. In practice, litigation and even high compensation due to product defects occur from time to time, which affects the normal production and operation of enterprises. With the increase of the amount of product liability compensation and the increase of product liability risk, the social understanding and demand of product liability insurance will also increase. Therefore, it is necessary to study product liability insurance systematically. This article will discuss the product liability insurance of our country and its influence on export enterprises and even on social economy from the aspects of legal system and citizen's legal consciousness. The full text is divided into seven parts. The first part of the article is an introduction. The second part introduces the theoretical basis of product liability insurance, expounds the concept and function of product liability insurance, as well as the difference between product liability insurance and general property insurance and credit insurance. The third part analyzes the current situation and existing problems of product liability insurance in China, and expounds the significance of product liability insurance to the healthy development of Chinese export enterprises. It shows that the legal system and people's understanding of insurance are the important factors that affect the development of product liability insurance, especially export product liability insurance. The fourth part, as a reference, introduces and analyzes the production and development of the product liability and its legal system in the United States and the European Union. The fifth part analyzes the influence of export product liability insurance on China's export enterprises and foreign trade, and shows that export product liability insurance is an important guarantee for the production and operation stability of export enterprises in the guarantor countries. Also is the guarantee our country economic growth an important aspect. The sixth part, based on the analysis of the above parts, puts forward some suggestions and countermeasures from the aspects of perfecting the legal system, raising insurance consciousness, training talents, and insurance management. Finally, the seventh part is the conclusion and prospect of the article. It is an important task to perfect the product liability and related legal system and to improve the social awareness of risk and insurance. With the social progress and economic development, product liability insurance will be greatly developed. Product liability insurance must be an important growth point of property insurance.
