我国推行食品安全强制责任保险的问题研究

【摘要】：随着社会的发展，我国食品安全责任保险市场逐渐出现了重大变革，党和国家高度重视食品安全问题，2013年8月26日上午习近平总书记考察了伊利集团，并了解企业生产经营、食品安全保障和节日市场供应等情况。习近平强调，要广泛普及食品与健康相关知识，推动全社会更加关注食品安全，坚决遏制各类食品安全违法犯罪行为，提高群众消费安全感和满意度。可见，，随着我国经济的不断发展、科学的逐渐进步、法制法规的日益完善，推行食品安全强制责任保险势在必行。 本文首先阐述了我国食品安全责任风险以及食品安全强制责任保险的基本概述，内涵及特征。其次在政府政策、法律制度等方面分析了我国推行食品安全强制责任保险的法律环境及有利条件。然后讨论了我国食品安全强制责任保险的发展现状以及我国推行食品安全强制责任保险的影响因素，并根据现状和影响因素找到具体问题。之后分析了国外及台湾推行食品安全责任保险的经验以及对我国的借鉴意义。最后，根据前文中问题的提出结合经验的借鉴勾勒出推行我国食品安全强制责任保险的具体对策：从法律法规、行政政策、强制推行、以及产品创新这些方面各个分析，以期能够为如何推行我国食品安全强制责任保险市场进一步发展做出贡献。
[Abstract]:With the development of the society, the food safety liability insurance market in China has gradually undergone major changes. The Party and the state attach great importance to the issue of food safety. On the morning of August 26, 2013, General Secretary Xi Jinping visited the Yili Group and learned about the production and operation of the enterprises. Food safety and holiday market supply and so on. Xi Jinping stressed that it is necessary to widely popularize knowledge on food and health, promote the whole society to pay more attention to food safety, resolutely curb all kinds of illegal and criminal acts of food safety, and increase the consumption of sense of security and satisfaction of the masses. It can be seen that with the development of economy, the progress of science and the improvement of laws and regulations, it is imperative to carry out compulsory liability insurance for food safety. At first, this paper expounds the basic outline, connotation and characteristics of food safety liability risk and food safety compulsory liability insurance in China. Secondly, the author analyzes the legal environment and favorable conditions of implementing compulsory liability insurance for food safety in China in the aspects of government policy and legal system. Then it discusses the current situation of the development of the compulsory liability insurance for food safety in our country and the factors influencing the implementation of the compulsory liability insurance for food safety in China, and finds out the specific problems according to the present situation and the influencing factors. Then it analyzes the experience of carrying out food safety liability insurance in foreign countries and Taiwan and its reference significance to our country. Finally, according to the above mentioned questions and experience, the author outlines the specific countermeasures of implementing the compulsory liability insurance of food safety in China: from the aspects of laws and regulations, administrative policies, enforcement, and product innovation. It is expected to contribute to the further development of China's food safety compulsory liability insurance market.
