中国（上海）自由贸易试验区海关监管制度研究

【摘要】：自由贸易是国际发展的趋势,美国、德国、新加坡等发达国家都设立了自由贸易区,这类特殊区域已经成为了区域经济一体化的主要形式之一。我国为了顺应世界经济形势的变化,在现有保税区、综合保税区等4类海关特殊监管区域基础上,建立了上海自由贸易试验区,进一步推动完善开放型经济体制机制。在当今法治社会的条件下,完善的法律制度是科学合理监管的基础。海关作为国家进出关境监督管理部门,是上海自由贸易试验区在监管方面的一个必不可少的重要行政机构。本文首先对自由贸易区的概念、类型以及我国自由贸易区建设的探索实践进行追溯,系统阐述了我国各类海关特殊监管区域的功能及海关监管的理论基础和作用。再结合上海自由贸易试验区的功能定位,阐述了当前海关监管的现状,并重点分析了目前上海自由贸易试验区海关监管制度存在的法制建设不健全、监管模式较落后、制度创新不足等问题,对改革创新进行理性思考,针对存在的问题,借鉴国外的成功经验,最终对上海自由贸易试验区海关监管制度提出一些可行的对策和目标,以完善海关监管工作。本文提出的对策和建议具有一定的现实实践意义和参考价值。
[Abstract]:Free trade is the trend of international development. The United States, Germany, Singapore and other developed countries have set up free trade zones, such special regions have become one of the main forms of regional economic integration. In order to adapt to the changes of the world economic situation, China has established Shanghai Free Trade Test Zone on the basis of four special customs supervision areas, such as the existing bonded area and the Comprehensive bonded Zone, in order to further promote the improvement of the open economic system mechanism. Under the condition of rule of law, perfect legal system is the basis of scientific and reasonable supervision. Customs, as a national supervision and administration department, is an indispensable administrative organization in the supervision of Shanghai Free Trade Test area. In this paper, the concept and types of free trade area and the exploration and practice of the construction of free trade area in China are traced back, and the functions of various special customs supervision areas in China and the theoretical basis and function of customs supervision and control are systematically expounded in this paper. Combined with the functional orientation of Shanghai Free Trade Test area, this paper expounds the current situation of customs supervision, and analyzes emphatically that the legal system of Shanghai Free Trade Test Zone is not perfect and the supervision mode is backward. This paper makes rational thinking on the reform and innovation, draws lessons from the successful experience of foreign countries, and finally puts forward some feasible countermeasures and objectives for the customs supervision system of Shanghai Free Trade Test area. In order to improve the work of customs supervision. The countermeasures and suggestions in this paper have some practical significance and reference value.
