深圳市娱乐服务行业劳资关系治理对策研究

【摘要】:随着社会发展的不断进步,各行各业的经济活动都日趋规范化,劳资关系作为社会经济活动中较为重要的社会关系之一,对社会、经济和谐稳定发展起到不容小觑的作用。自改革开放以来,深圳市服务行业得到了快速发展,深圳市的服务行业已经成为了全市经济的重要组成部分。随着深圳市服务行业的不断发展,其经济活动的过程中出现的劳资关系问题也引起了社会各界的普遍关注,解决劳资关系问题、稳定社会发展是当前摆在我们面前的一项重要任务。本文以深圳市娱乐服务行业劳资关系为研究对象,分析劳资关系的基本概念和劳资关系治理的含义,提出了和谐劳资关系的特征和构建和谐劳资关系的基本原则。以深圳市罗湖区娱乐服务行业的劳资关系治理为例,通过经营主体、从业人员、劳资关系的现状为出发点,探讨服务行业劳资关系存在的问题及原因,较为突出的现实问题为变显性违法为隐性违法;变集中收取为逐月克扣;变单独维权为串联维权;变劳动关系为劳务关系,并从社会因素、企业因素、从业人员因素、政府监管因素几个方面分析出现以上问题的原因。作为治理区域劳资关系的罗湖区劳动行政部门,通过举办普法培训、推进签订集体合同、严格把控特殊工时审批来加强事前控制、规范劳动用工管理,同时做好信访和调解工作、引入第三方社会力量开展调解等措施强化信访争议调处机制,启用电子化监督、创新仲裁配套服务提高仲裁效率,严惩欠薪、提质提速、规范劳动监察制度等手段,有效避免或减少了劳资纠纷问题的发生。由案例分析出劳资关系治理存在的问题,在遵循原则的基础上,结合实际情况,提出具有实操性的合理化建议:完善系统性的配套政策,加大源头控制力度、强化劳资纠纷预防机制,梳理劳动信访秩序、引导员工依法守序上访,多方联动、加强劳资纠纷事中处置事后稳控措施,明确娱乐服务行业定位优化产业布局,充分发挥工会组织协调劳动关系的积极作用,积极引导行业协会的成立。从事前、事中、事后的角度提出治理对策,以平衡劳资关系力量,保障劳动者的合法利益,确保娱乐服务行业的健康稳定和谐发展。
[Abstract]:With the continuous progress of social development, economic activities in all walks of life are becoming more and more standardized. As one of the more important social relations in social economic activities, labor relations play an important role in the harmonious and stable development of society and economy. Since the reform and opening up, the service industry in Shenzhen has developed rapidly, and the service industry has become an important part of the economy of Shenzhen. With the continuous development of the service industry in Shenzhen, the problems of labor relations in the process of its economic activities have also aroused widespread concern from all walks of life in the society. Stabilizing social development is an important task facing us at present. This paper takes the industrial relations of entertainment service industry in Shenzhen as the research object, analyzes the basic concept of the labor relations and the meaning of the management of the labor relations, puts forward the characteristics of the harmonious labor relations and the basic principles of constructing the harmonious labor relations. Taking the management of industrial relations in the entertainment service industry of Luohu District in Shenzhen as an example, this paper discusses the problems and causes of the labor relations in the service industry through the starting point of the present situation of the business subjects, employees and labor relations. The more prominent practical problems are changing overt illegal to recessive illegal; changing concentrated collection into monthly deduction; turning individual rights protection into series rights; changing labor relations into labor relations, and changing social factors, enterprise factors, and employees' factors, The reasons for the above problems are analyzed in several aspects of government supervision. As the administrative department of labor in Luohu District, which governs the regional labor relations, by organizing training in popularizing the law, promoting the signing of collective contracts, strictly controlling the examination and approval of special working hours to strengthen prior control, and standardizing the management of labor and employment, At the same time, we should do a good job in the work of petition and mediation, introduce third party social forces to carry out mediation and other measures to strengthen the mechanism of handling disputes between letters and visits, use electronic supervision, innovate the matching services for arbitration, improve the efficiency of arbitration, severely punish arrears of pay, and speed up quality and speed. Standardizing labor inspection system can effectively avoid or reduce the occurrence of labor disputes. On the basis of following the principle and combining with the actual situation, the paper analyzes the problems existing in the management of labor relations by case, and puts forward some reasonable suggestions with practical characteristics: perfecting the systematic supporting policies, increasing the control of the source, Strengthen the labor dispute prevention mechanism, comb the order of labor petition, guide the staff to follow the order of petition, cooperate with each other, strengthen the measures of stability and control in dealing with the labor dispute, clarify the position of entertainment service industry, optimize the industrial layout, Give full play to the positive role of trade union organizations in coordinating labor relations and actively guide the establishment of trade associations. In order to balance the strength of labor relations, protect the legitimate interests of laborers and ensure the healthy, stable and harmonious development of the entertainment service industry, the author puts forward some countermeasures from the perspective of the former and the latter.
