【摘要】:劳动关系是最基本的社会生产关系,劳动关系的存在与发展情况,既关系着个体劳动者与用人单位的直接利益,同时更关系着劳动者的家庭发展,关系到社会经济发展,因此和谐劳动关系既是建设社会主义和谐社会的重要组成部分,也是实现社会和谐稳定的必要条件。在我国经济体制改革过程中,用人单位形式、用工形式、用人单位与劳动者之间的关系发生了巨大改变,劳动关系也呈现出新的特点,同时不可忽视的是,我国现有的劳动关系面临着就业形势严峻、资强劳弱、劳动者工资收入分配不公平、收入差距不断扩大、劳动者合法权益保护不充分等诸多问题,逐渐进入了矛盾的易发期和多发期,直接影响了社会公平正义的实现,影响了社会的发展与和谐稳定。究其原因包括了法律制度体系、价值导向、利益分配、协调机制、监察监管、争议处理等多方面的原因。要解决劳动关系中的现实问题,构建我国和谐劳动关系,需要包括各类用人单位、劳动者、各种社会团体、组织甚至是每一名公民的共同努力,这一过程中更离不开政府职能的正确有效发挥。从不同层面划分,劳动关系有着不同的含义,本文重点在于探讨最狭义的劳动关系,即劳动者与用人单位因生产、劳动而产生的权利义务关系,以及在狭义劳动关系中,政府为实现“和谐”而应当承担的职责。作为劳动关系中的第三方主体,政府应当明确和谐劳动关系的标准,充分认识构建和谐劳动关系的现实意义,并在准确定位、转变职能、自我完善的基础上,用好“看不见的手”和“看得见的手”,处理好企业、市场与政府的关系,充分发挥自身在和谐劳动关系构建过程中的培育作用和规制职能,既遵循劳动市场规律,尊重用人单位生产经营与内部管理的自主权,又能够对劳动关系给予必要而适度的干预和调整,有效协调利益关系、保护作为弱势方的劳动者的合法权益。这一方面,需要政府营造劳动至上的社会氛围,树立公平正义的价值取向,不断提高劳动者的社会地位,培育平等的劳资市场,促进就业稳定和供需平衡,充分发挥三方协调机制、工会以及其他社会组织在劳动关系中的积极作用,有效调整、平衡用人单位与劳动者之间的利益关系,促成集体谈判,实现劳资两利、合作共赢,为构建和谐劳动关系培育良好的社会氛围和发展环境;另一方面,政府应当运用好手中的公权力,不断健全劳动法律法规,完善劳动关系和谐运行的制度环境,合理分配社会资源,缩小收入差距,使劳动者充分享受社会发展的成果,严格监察执法,保障劳动者安全、健康、体面劳动,快速化解劳动争议纠纷,维护劳动者和用人单位双方的合法权益,保障、促进劳动关系和谐稳定发展。
[Abstract]:Labor relation is the most basic social relations of production, existence and development of labor relations, not only affects the individual worker with the direct interests of the employer, at the same time it affects workers family development, related to the social and economic development, the harmonious labor relations is not only an important part of building a socialist harmonious society, but also a necessary the conditions of social harmony and stability. In the process of economic reform in our country, employers, employment forms, the relationship between the employer and the employee has undergone tremendous change, labor relations have also shown new features, but can not be ignored is that the current labor relations in China are facing severe employment situation strong capital, weak labor and wages of workers, unfair distribution of income, the income gap continues to expand, do not fully protect the legitimate rights and interests of workers and many other issues, has gradually entered the prone period of contradiction And multiple period, directly affects the realization of social fairness and justice, the impact of social development and harmony and stability. The reasons include the legal system, value orientation, distribution of interests, coordination mechanism, supervision supervision, many reasons for dispute processing. To solve practical problems of labor relations in the construction of the relationship between harmonious labor of our country, need to include all types of employers, workers, various social groups, organizations and even the joint efforts of every citizen, this process cannot do without the government functions correctly and effectively play. Divided from the different levels of labor relations have different meanings, this paper focuses on the narrow sense labor relations, workers and employers because of production, labor and produce the relationship of rights and obligations, and in the narrow sense of labor relations, the government for the realization of "harmony" and should bear the responsibilities as labor relations in the article. The three parties, the government should define the harmonious labor relations standards, fully understand the significance of constructing harmonious labor relations, and changes in the functions of accurate positioning, self perfection, based on the use of the "invisible hand" and "visible hand", handle the relationship between government and enterprises, and fully exert the advantage of constructing harmonious labor relationship in the process of cultivating and regulating functions, not only follow the labor market rules, respect for production management and internal management unit autonomy, and can give the necessary and appropriate intervention and adjustment of labor relations, effective coordination of interests, the protection of laborers as the weak party's legitimate rights and interests. On the one hand, the government should construct labor oriented social atmosphere, establish a fair and just value orientation, and constantly improve the social status of the laborer, the labor market to promote the cultivation of equality, stability and employment The balance of supply and demand, give full play to the three party coordination mechanism, trade unions and other social organizations in the labor relations of the positive role, effective regulation, the balance between the employer and the employee's interests, to achieve collective bargaining, labor and capital, win-win cooperation, to cultivate the social atmosphere and a good environment for the development of harmonious labor relations; the other hand, the government should use public power in the hands of, and constantly improve the labor laws and regulations, improve the institutional environment of harmonious labor relationship, reasonable distribution of social resources, to narrow the income gap, the workers to fully enjoy the fruits of social development, and strict supervision of law enforcement, labor safety and health, decent work, quickly resolve labor disputes, safeguard both employers and workers' legitimate rights and interests, safeguard and promote the stable development of the harmonious labor relations.
