人防工程产权制度改革研究

【摘要】：人民防空工程是一项重要的人防战备设施,对提升人民防空袭斗争的能力具有十分重要的作用。随着市场化改革的深入推进,我国人民防空工程建设政策体系已经不适应需求,在新的形势下,充分发挥市场在人防工程资源配置中的作用、引导和规范社会资金投资人防工程、更好地发挥人防工程整体效益等都对人防工程产权制度改革提出了现实要求。为此,理论和实践中都对人防工程产权制度改革进行了深入探索。改革的实施提高了人防工程的总体建设水平,产生了良好效益,但也存在诸多不足,有深化改革的必要。同时,全国人防工程产权制度改革缺少系统性和规范性,尚未形成标准改革模型和实现途径。本文通过对Y市人防工程产权制度改革的实证研究,形成了人防工程产权制度改革经验,探索了适用于全国人防工程体系的产权制度改革模型,明确了政策制定和执行中的重要内容并形成了措施方法,对深化Y市人防工程产权制度改革提出了自己的见解,对开展全国性的人防工程产权制度改革提出了建议。另外,本文有力检验和丰富现有人防工程产权制度改革理论体系。在研究框架上,首先梳理了Y市人防工程产权制度改革方案的政策体系,并结合现有理论进行了初步分析。然后,从总体效果和产权效益两个方面汇总了产权制度改革后Y市人防工程建设的成果,并进行了定性分析、定量分析和相关性分析,形成了土地使用权获取等在产权制度改革中的一些关键性的问题。之后,以关键性问题为切入点,深入研究了Y市人防工程产权制度改革的经验和不足,并探索了深化改革的措施。最后,在前文分析结论的基础上,对深化我国人防工程产权制度改革提出建议。由于人防建设的特性,国外相关可以借鉴的资料也很少,为了深入研究、取得有意义的结论,本文注重研究创新。在研究方法创新方面：一是研究视角上,从有利于人防工程整体建设效果的角度出发,先明确人防工程所有权归属,进而研究了相关实现细节。二是在研究对象的梳理上,将人防产权制度改革分解为所有权归属和国有产权分离两个相互独立而又相互联系的内容,针对改革现状,将研究对象明确为所有权归属改革。三是定性分析中借助现有工具。为了阐述人防工程民营化的经济效益,借助了物权法的概念,通过梳理分析了人防工程产权制度改革可以增加的物权内容,然后分析了增加物权的经济价值,从而使研究更体系化。四是在定量分析上,在反应人防工程总体建设状况及产权改革状况的数据选取、数据的相关性分析上、对数据内容的比较利用上,都进行了创新性的探索。在结论创新方面：一是以是否可经营和是否具有经营效益划分人防工程投资范围,不可经营的必须由国家投资建设,可经营且具有良好经济效益的必须由社会投资建设,可经营但经营效益差的可以由国家或社会投资,社会具有建设的优先权。二是在产权归属上,产权归投资者所有,国有可经营人防工程可以通过正常的市场交易实现民营。三是在土地使用权的获取上,对不同类型的人防工程设定了不同的土地使用权获取方式和土地使用证办理方式。四是针对人防工程特性,对人防工程产权设定特殊的权力义务。五是在体系构建上,将人防工程产权制度改革与人防工程建设主体责任的调整、人防工程易地建设费的改革结合在一起。
