建设工程质量政府差别化监管方式研究

【摘要】：当前,建设工程领域不断发展变化的新形势对政府部门工程质量监管能力提出了更高的要求,需要进一步研究和探索适合我国国情、符合客观规律的建设工程质量政府监督管理方式,从而提高监管效率和水平。本文对国内外现有相关研究成果进行回顾,为研究提高工程质量政府差别化监管能力和效率提供理论支持。分别从横、纵向对我国建设工程质量政府监督管理的沿革和现状进行分析,从总体上把握其监管特征,并总结分析发达国家差别化监管的特点以及借鉴意义,一是应强调政府对公共工程质量差别化监管;二是应进一步规范政府差别化监管程序和内容;三是应进一步改进差别化监管手段和方法,从而为明确政府差别化监管的相关原则以及提出实施措施奠定基础。本文立足现行法律法规和体制机制,从整体层面上确定差别化监管的原则,并提出构建系统化、定量化的建设工程质量政府差别化监管方式,包括工程质量风险识别体系、工程质量差别化监管模式、差别化监管动态修正机制等措施,以期达到优化监管资源配置的目标。并以天津市河西区为例,对实施建设工程质量政府差别化监管方式进行实证研究,从而证明本文所具有的实践指导意义,可以为相关职能部门采取工程质量差别化监管方式提供一定参考。
[Abstract]:At present, the new situation of continuous development and change in the field of construction engineering puts forward higher requirements for the ability of engineering quality supervision of government departments, and needs to be further studied and explored to suit the national conditions of our country. The government supervision and management mode of construction project quality conforms to the objective law, so as to improve the efficiency and level of supervision. This paper reviews the existing research results at home and abroad to provide theoretical support for the study of improving the ability and efficiency of government differential supervision of engineering quality. This paper analyzes the evolution and current situation of government supervision and management of construction engineering quality in China from horizontal and vertical respectively, grasps the characteristics of supervision in general, and summarizes and analyzes the characteristics of differential supervision in developed countries as well as the significance for reference. First, the government should pay more attention to the differential supervision of public works quality; Secondly, the procedures and contents of government differential supervision should be further regulated, and the means and methods of government differential supervision should be further improved in order to lay a foundation for making clear the relevant principles of government differential supervision and putting forward the implementation measures. Based on the existing laws, regulations and institutional mechanisms, this paper determines the principle of differential supervision on the whole level, and puts forward a systematic and quantitative way of government differential supervision of construction project quality, including the identification system of engineering quality risk. In order to achieve the goal of optimizing the allocation of supervision resources, measures such as engineering quality differentiation supervision mode, differential supervision dynamic correction mechanism and so on are expected to reach the goal of optimizing the allocation of supervision resources. Taking Hexi district of Tianjin as an example, this paper makes an empirical study on the implementation of the government differential supervision mode of construction project quality, thus proving the practical guiding significance of this paper. It can provide some reference for the relevant functional departments to adopt the supervision mode of engineering quality differentiation.
