【摘要】：随着知识经济时代的到来,知识产权对经济增长和产业竞争力提升发挥着越来越重要的作用,推动知识产权转化为现实生产力已成为驱动我国经济发展的重要任务之一。国防知识产权是国防科技创新的重要成果,不仅能够加快转变战斗力生成模式,还蕴含着巨大的经济潜力。然而,当前我国国防知识产权交易水平与经济社会发展需求存在一定差距,大量国防知识产权停留在一次性任务应用,甚至作为技术储备被束之高阁,创新驱动效应不明显,还处在从发展拉动创新向创新驱动发展的过渡阶段。因此,必须加紧研究推进国防知识产权交易的方式方法。本文基于交易成本经济学,从治理的角度研究了如何推动国防知识产权交易的问题。治理的目的在于构建合适的体制机制,保障国防知识产权交易更好地进行。以国防知识产权交易为分析对象,从交易主体之间的相互关系入手,逐步构建出适用于多样化国防知识产权交易治理体系。主要研究内容包括:1、国防知识产权及其交易本质研究。首次提出国防知识产权具有资本属性,具有保值增值的本质特征。推动国防知识产权交易的重要价值在于让国防知识产权在参与生产经营的过程中实现保值增值,并激励创新,最终驱动经济社会发展。其驱动作用不仅表现为提高战斗力和加快转变战斗力生成模式,还在于驱动经济增长。但定量分析表明,当前我国国防知识产权转化的驱动效应不明显,因此需要研究如何对国防知识产权交易进行治理。2、国防知识产权交易系统分析研究。国防知识产权交易方式的实质是制度安排,本文详细分析了国防知识产权转化的交易主体、交易关系、交易现状和制度环境,提出了国防知识产权转化的四种交易属性:保密性、资产专用性、不确定性和交易频率,其中保密性是国防知识产权转化交易与其他交易相异的首要属性。3、国防知识产权交易的四种治理结构研究。分析表明,为降低国防知识产权交易的交易成本,治理结构必须与交易属性相匹配,根据国防知识产权交易的交易属性,将国防知识产权交易的治理结构划分为:市场治理、科层治理、双方治理和三方治理四种,从而创造性地构建出多样化的国防知识产权交易治理体系。四种治理结构同时存在、各有特点,是相互竞争和相互替代的组织资源配置方式。不同的治理结构不存在本质上的优劣,只有与国防知识产权交易的交易属性相匹配的治理结构才是适用的。针对每种治理结构的特点和不足,本文通过系统分析、案例分析、建立数理模型、博弈模型等方法,提出了完善的相关办法。

The main research contents include: 1. Research on the nature of the transaction and defense of intellectual property rights.
