私法自治视角下现阶段我国劳动关系社会治理研究——以新生代农民工为例

【摘要】：劳动关系是社会关系的主轴。在私法自治视角下劳动关系资强劳弱的根源在于市场经济自身逻辑,劳动关系冲突的根源也在于市场经济自身逻辑。劳动关系社会治理的中心问题在于改变这种逻辑结构,其力量来源于劳工组织权利能力的法律确认,只有劳动三权得到法律确认使其从劳动者的道德权利上升为法律权利,劳工组织才有力量与雇主抗衡。劳动三权既是劳动关系社会治理的基础,又是限制私法自治权利滥用实现初次分配正义和劳动关系和谐的劳动权利保障。如果把劳动者的权利关进笼子不仅是劳动者的悲哀也是执政者的烦恼。
[Abstract]:Labor relations is the spindle of social relations. In the autonomy of private law from the perspective of labor relations and strong capital weak labor is the source of its own market economy logic, causes the conflicts of labor relations is also the center of market economy itself logic. The problem of labor relation and social governance is to change the logic structure, its power comes from the labor organization the right legal confirmation only, three labor rights confirmed by law which rose from the workers' moral rights as legal rights, labor organizations and employers have the power to compete. Three power is the foundation of labor labor relations of social governance, but also limit the autonomy of private law rights abuse to achieve initial distribution of justice and harmonious labor relations labor rights. If the laborer right into the cage is not only the workers sorrow is ruler's troubles.
