基于政府作用视角的劳务派遣研究

【摘要】:劳务派遣用工方式是我国实施改革开放、建立社会主义市场经济的产物。劳务派遣作为一种新兴的用工方式,因其具有多种优点,也因为市场经济的需要,已经成为我国一种重要的用工方式,同时为我国众多劳动力提供了更多的就业机会和职业选择,在经济全球化的今天,异地派遣和对外派遣的形式也越来越受到雇主的青睐。劳务派遣的高速发展也带来相应的问题:用工单位滥用劳务派遣人员,派遣行业经营混乱,劳动者权益难以得到有效保障等,这些问题不仅会导致劳务派遣行业不健康发展,甚至会影响到整个社会主义市场经济的发展。本文从劳务派遣现状及问题表现出发,指出了劳务派遣问题的产生原因,并基于协同理论构建了劳务派遣体系。 首先,本文的第一部分介绍了论文选题的背景、理论及实践意义,总结了目前国内外对于劳务派遣研究的现状,概括了本文的内容及结构,阐述了劳务派遣的基本概念以及本文中需要用到的相关理论。 其次,本文介绍了我国劳务派遣的产生原因,并从行业总体特征、用工单位、派遣公司、被派遣劳动者四个方面介绍了劳务派遣行业现状。然后根据我国劳务派遣行业的现状,指出了我国劳务派遣问题的表现,并通过博弈分析方法找到了劳务派遣问题产生的深层次原因—三方主体追求利益最大化的行为导致了问题的产生,除此之外,政府作用不完善也是导致劳务派遣问题的重要原因。 再次,本文通过借鉴国外先进的劳务派遣规制经验,分析劳务派遣用工的要点,基于协同理论,构建出我国劳务派遣体系,说明了劳务派遣体系的要点,明确了劳务派遣体系中各方主体的职责,重点阐述了劳务派遣问题中政府职能,还为劳务派遣体系构建了相关的配套体系。 最后,,为劳务派遣体系的实施做了政策上的可行性分析,指出了劳务派遣体系的现实价值,并给出了政府及各方主体在劳务派遣体系实施过程中的对策建议及保障措施。
[Abstract]:Labor dispatch is the result of China's reform and opening up and the establishment of a socialist market economy. As a new mode of employment, labor dispatch has many advantages and needs of the market economy. Has become an important mode of employment in our country, and at the same time has provided more employment opportunities and career options for many of our country's labor forces. Today, with the economic globalization, The rapid development of labor dispatch also brings the corresponding problems: employment units abuse labor dispatch personnel, dispatch industry management chaos, The rights and interests of laborers are difficult to be effectively protected. These problems will not only lead to the unhealthy development of the labor dispatch industry, but also affect the development of the socialist market economy. This paper points out the causes of the labor dispatch problem, and constructs the labor dispatch system based on the cooperative theory. First of all, the first part of this paper introduces the background, theory and practical significance of the thesis, summarizes the current domestic and foreign research on labor dispatch, summarizes the content and structure of this paper. This paper expounds the basic concept of labor dispatch and the relevant theories that need to be used in this paper. Secondly, this paper introduces the causes of labor dispatch in China, and from the overall characteristics of the industry, employment units, dispatch companies, This paper introduces the present situation of the labor dispatch industry in four aspects, and then points out the performance of the labor dispatch problem in our country according to the present situation of the labor dispatch industry in our country. And through the game analysis method to find out the deep-seated reason of the labor dispatch problem-the behavior of the tripartite main body to pursue the benefit maximization causes the problem, in addition, the third party main body pursues the benefit maximization behavior to cause the question. The imperfect role of the government is also an important reason for the problem of labor dispatch. Thirdly, this paper analyzes the key points of labor dispatch by using foreign advanced experience of labor dispatch regulation for reference, and constructs the labor dispatch system of our country based on the cooperative theory, and explains the main points of the labor dispatch system. This paper clarifies the responsibilities of the main bodies in the labor dispatch system, focuses on the government functions in the issue of labor dispatch, and constructs a related supporting system for the labor dispatch system. Finally, the paper makes a policy feasibility analysis for the implementation of the labor dispatch system, points out the practical value of the labor dispatch system, and gives the countermeasures, suggestions and safeguards of the government and the parties involved in the implementation of the labor dispatch system.
