我国食品安全监管中地方政府执行力的问题研究

【摘要】：食品安全与我们的生活息息相关,食品安全事件频发,往往会把我们的焦点集中到食品安全监管上来,然而在食品安全监管中地方政府执行力对其影响重大,目前地方政府执行力的问题的研究虽然取得了一定的成果,但是在食品安全监管中地方政府执行力的问题研究还存在着空白,如何改善食品安全监管中地方政府执行力不足的问题仍然是一个需要深入探讨的课题。本文从政策执行的视角,结合相关的管理学、行政法学的相关学科的基本理论,阐述了食品安全监管、地方政府执行力等相关的概念,论述了地方政府执行力对食品安全监管的影响,探讨了食品安全监管中地方政府执行力存在的问题,在分析问题的基础上一步步揭示出了问题产生的原因,最后提出了解决问题的对策。全文共分为四个部分：导论为本文的第一部分包括选题缘由和研究意义、研究的现状述评、研究方法与主要内容、本文的特点与创新点。第二部分主要是对食品安全监管中地方政府执行力的问题做出相关概念的概述。首先,论述了食品安全监管和地方政府执行力的基本概念,提出了地方政府执行力的表现形式,在执行活动的不同阶段分别表现为领会力、预测力、计划力、服从力、组织力、创新力、评估力、问责力和调整力。然后主要阐述提升地方政府执行力对于强化食品安全监管的意义。第三部分主要是阐述我国食品安全监管中地方政府执行力不足的表现,它的表现分别为：机械执行、选择执行、逃避执行、代替执行、被动执行,通过这些不足的表现深挖出产生其中的原因,分别从执行各方的利益博弈、执行主体的素质缺失、执行环境的制约和限制、执行对象的抗拒不从、执行资源的匮乏这五个方面来分析。第四部分,主要是针对原因提出提升食品安全监管中地方政府执行力的途径。分别是在地方政府的执行过程中把政策执行原则贯穿始终；改善中央和地方、各部门间的关系；加强执行主体的建设；改善执行环境；优化执行手段、增强食品企业责任意识；加强自我监管；完善执行机制。在最后的结语中对本文的公共政策执行视角下的食品安全监管中地方政府执行力的问题研究的观点进行进一步的提炼和总结。
[Abstract]:Food safety is closely related to our daily life. With the frequent occurrence of food safety incidents, we tend to focus on food safety supervision. However, in food safety supervision, the executive power of local governments has a great impact on it.Although some achievements have been made in the study of the executive power of local governments, there is still a gap in the study of the executive power of local governments in food safety supervision.The problem of how to improve the executive power of local governments in food safety supervision is still a topic to be deeply discussed.From the perspective of policy implementation, combined with the basic theories of relevant disciplines of management and administrative law, this paper expounds the related concepts of food safety supervision, local government executive power, and so on.This paper discusses the influence of the executive power of the local government on the supervision of food safety, probes into the problems existing in the executive power of the local government in the supervision of food safety, and reveals the causes of the problems step by step on the basis of the analysis of the problems.Finally, the countermeasures to solve the problem are put forward.This paper is divided into four parts: the first part of the introduction includes the reason and significance of the topic, the current situation of the research, the research methods and main contents, the characteristics and innovation of this paper.The second part is mainly to the food safety supervision in the local government executive power to make the related concept outline.First of all, the basic concepts of food safety supervision and local government executive power are discussed, and the expression forms of local government executive power are put forward. In the different stages of execution activities, they are respectively shown as comprehension, prediction, planning, serviceability, organization, etc.Innovation, Evaluation, Accountability and Adjustment.Then it mainly expounds the significance of enhancing the executive power of local government to strengthen food safety supervision.The third part mainly expounds the performance of the insufficient executive power of the local government in the food safety supervision in our country. Its performance is: mechanical execution, selective execution, escape execution, instead of execution, passive execution.Through the performance of these deficiencies to dig out the causes, respectively, from the implementation of the interests of all parties to the game, the quality of the executive lack of the implementation of the environment constraints and restrictions, the object of the implementation of resistance,Implementation of the lack of resources to analyze the five aspects.In the fourth part, the author puts forward the ways to improve the executive power of local government in food safety supervision.In the process of implementation of local government, the principles of policy implementation should be carried out throughout; the relationship between central and local governments should be improved; the construction of executive body should be strengthened; the environment of execution should be improved; the means of implementation should be optimized; and the sense of responsibility of food enterprises should be enhanced.Strengthen self-supervision and improve the implementation mechanism.In the final conclusion, the author further refines and summarizes the viewpoints of the research on the executive power of the local government in the food safety supervision from the perspective of public policy implementation.
