我国私营企业劳动关系三方协商机制中的政府作用研究

【摘要】:构建和谐劳动关系是我国构建和谐社会的题中之意。党和政府始终都高度重视维护与促进劳动关系的稳定和谐。我国当前劳动关系整体和谐,局部冲突和矛盾仍然广泛存在,而在我国劳动关系冲突中,私营企业又因其起步晚、发展不完善等原因居于主要的地位,因此解决私营企业劳动关系不和谐因素是我国劳动关系整体建设的首要任务。当前三方协商机制被国际上广泛认为是调解劳动关系、实现劳动关系有序运行的最有效方法,我国私营企业三方存在有别于西方资本主义国家的特殊形态,政府在完善三方协商机制建设上任重道远。 本文选择“我国私营企业劳动关系三方协商机制中的政府作用”为题进行研究,按照逻辑顺序层层推进。本文第二章是全篇研究的理论和现实基础。在本章中笔者首先对政府调节劳动关系的相关理论进行了梳理,,对政府在私营企业劳动关系三方协商机制中发挥作用的方式进行了分析,分别作为全篇研究的理论基础和技术线路。本章的另一个重点是对私营企业劳动关系三方协商中存在的问题的整理,该部分是本文研究的现实基础之一;本文的第三章和第四章是全文的主体。在第三章中,笔者首先对我国政府在私营企业劳动关系三方协商机制中的作用的历史变迁及其现状进行了归纳分析,而后又对我国政府在私营企业劳动关系三方协商机制中作用的不足进行了总结,为全篇的研究搭好了基石。本文第四章关于国外发达国家在三方协商机制中的作用借鉴对本文结论的形成具有重要的指导意义;本文的第五章是全文的结论部分,本章在全文研究的基础上对我国政府在私营企业劳动关系三方协商机制中的作用目标、作用界限进行了界定,并提出了具体的对策和建议措施。
[Abstract]:Constructing harmonious labor relationship is the meaning of constructing harmonious society in our country. The Party and the government have always attached great importance to maintaining and promoting the stability and harmony of labor relations. At present, the labor relations in our country are harmonious, local conflicts and contradictions still exist widely. However, in the conflicts of labor relations in China, private enterprises are in the main position because of their late start and imperfect development. Therefore, solving the disharmonious factors of labor relations in private enterprises is the primary task of the overall construction of labor relations in China. At present, the tripartite consultation mechanism is widely regarded as the most effective way to mediate the labor relations and realize the orderly operation of the labor relations. There is a special form of the tripartite of the private enterprises in our country, which is different from the western capitalist countries. The government has a long way to go to improve the tripartite consultation mechanism. This paper chooses "the role of government in the tripartite consultation mechanism of labor relations of private enterprises in our country" as the topic to carry on the research, and advances in the logical order layer by layer. The second chapter is the theoretical and practical basis of the whole study. In this chapter, the author firstly combs the relevant theories of government regulation of labor relations, and analyzes the ways in which the government plays a role in the tripartite consultation mechanism of private enterprise labor relations. Respectively as the theoretical basis of the whole study and technical circuit. Another important point of this chapter is to sort out the problems existing in the tripartite negotiation of the labor relations of private enterprises, which is one of the realistic bases of this paper, and the third and fourth chapters are the main body of the thesis. In the third chapter, the author summarizes and analyzes the historical changes and the present situation of the government's role in the tripartite consultation mechanism of the private enterprise labor relations. Then it summarizes the deficiency of the government's role in the tripartite consultation mechanism of the private enterprise labor relations, which lays the foundation stone for the whole study. The fourth chapter on the role of foreign developed countries in the tripartite consultation mechanism has an important guiding significance for the formation of this conclusion, the fifth chapter is the conclusion of the full text, On the basis of the full study, this chapter defines the target and function limits of the government's role in the tripartite consultation mechanism of private enterprise labor relations, and puts forward some concrete countermeasures and suggestions.
