非公企业和谐劳动关系构建研究

【摘要】:合作共赢的和谐劳动关系对于企业发展、劳动者权益保护及社会稳定而言,至关重要,堪称整个社会发展的晴雨表。改革开放30多年来,中国的非公企业获得了巨大的发展,但是与此不相符的是中国非公企业的劳动关系在整体协调、稳定的同时,并没有像人们所希望的那样健康良性的发展,而是有种种不和谐的表现。近年来,非公企业劳资利益失衡,劳资矛盾引发的群体性事件频发,劳资矛盾和冲突日益凸显给执政者带来了巨大压力。因此,构建和谐劳动关系,在现阶段显得尤为紧迫和重要。 本文的研究主题为“非公企业和谐劳动关系构建研究”,旨在通过对于非公企业劳动关系的实证分析,探索在改善非公企业劳动关系,保障劳动的公平和正义,以及探索促进劳动关系和谐发展的可行性路径。本文共有五章,第一章为绪论部分,主要是对国内外对劳动关系的研究理论及对理论的分析。第二章是非公企业相关概念和理论部分,介绍“非公企业、和谐劳动关系”的内涵和特征、非公企业劳动关系和谐度的评价标准、非公企业和谐劳动关系的构建要素。第三章是介绍非公企业劳动关系现状,重点分析非公企业劳动关系中存在的问题,主要获取的方式是通过文献资料的收集分析和对2013年安徽省总工会对安徽省非公企业调研资料的整理。第四章是分析非公企业劳动关系不和谐问题产生的原因,通过理论和实证研究分析存在问题的根源。第五章是对策和建议部分,主要探讨针对非公企业存在的问题,提出从多方面解决非公企业劳动冲突,促进和谐劳动关系发展的意见和建议。 本文提出构建非公企业和谐劳动关系,应牢固树立科学管理理念和政绩观,发挥政府的主导性作用;强化劳动标准执法,引导企业积极履行社会责任;推进工会制度性转换,增强工会组织的自主性和独立性;确立和保障劳动者权益,建立健全劳动法律制度;从而构建社会多方共同参与,政府责任、企业责任和劳动者责任的相互统一、相互促进的和谐劳动关系。
[Abstract]:The harmonious labor relationship of cooperation and win-win is very important to the development of enterprises, the protection of workers' rights and interests and social stability, and can be regarded as a barometer of the development of the whole society. After more than 30 years of reform and opening up, China's non-public enterprises have achieved tremendous development. However, what is not in line with this is that the labor relations of China's non-public enterprises are coordinated and stable as a whole, and at the same time, there is no healthy and benign development as people hope. There are all kinds of dissonance. In recent years, the interests of non-public enterprises are out of balance, the collective events caused by labor conflicts occur frequently, and the conflicts between labor and capital bring great pressure to those in power. Therefore, the construction of harmonious labor relations, at this stage is particularly urgent and important. The theme of this paper is "Research on the Construction of harmonious Labor Relations in Non-public Enterprises", which aims at improving the labor relations of non-public enterprises and ensuring the fairness and justice of labor through the empirical analysis of the labor relations of non-public enterprises. And explore the feasible path to promote the harmonious development of labor relations. There are five chapters in this paper. The first chapter is the introduction part, which mainly analyzes the research theory and theory of labor relations at home and abroad. The second chapter is the related concepts and theories of non-public enterprises. It introduces the connotation and characteristics of "non-public enterprises, harmonious labor relations", the evaluation standard of non-public enterprises' harmonious degree of labor relations, and the construction elements of non-public enterprises' harmonious labor relations. The third chapter is to introduce the current situation of labor relations in non-public enterprises, focusing on the analysis of the existing problems in the labor relations of non-public enterprises. The main way to obtain is through the collection and analysis of literature data and the Anhui Federation of Trade unions in 2013 to Anhui Province non-public enterprises survey data collation. The fourth chapter is to analyze the causes of the problem of labor disharmony in non-public enterprises and analyze the root causes of the problems through theoretical and empirical research. The fifth chapter is the countermeasure and the suggestion part, mainly discusses the question which the non-public enterprise exists, proposes from many aspects solves the non-public enterprise labor conflict, promotes the harmonious labor relations development the opinion and the suggestion. In order to construct harmonious labor relations in non-public enterprises, we should firmly establish scientific management concept and political achievement view, give play to the leading role of the government, strengthen the enforcement of labor standards, and guide enterprises to fulfill their social responsibilities actively. To promote the institutional transformation of trade unions, to enhance the autonomy and independence of trade union organizations, to establish and protect the rights and interests of workers, to establish and improve the labor legal system; In order to build a harmonious labor relationship, social multi-party joint participation, government responsibility, corporate responsibility and laborer responsibility are United and promote each other.
