绍兴县生产领域食品安全监管及对策研究

【摘要】：随着消费者对食品质量要求的不断提高,食品安全成为了全社会关注的焦点问题。从某程度上理解,食品安全可定义为一项公共产品,政府有责任和义务保障食品的整体质量和安全。但现实却是各种恶性的食品安全事件层出不穷,我们还能吃什么——迫切的拷问着我国现行的食品安全监管体制。纵观我国食品安全的情况,存在着诸多问题,如部门之间的协调差、监管法律法规不成熟、政府规制效率低下、监管体系条块化、利益部门化等。究其根源主要是两大方面,一是市场失灵,由于信息不对而产生的食品安全风险在整个食品供应链上不断传导放大是食品安全问题产生的根本原因;二是政府失灵,政府在市场经济环境中扮演着守夜人的角色,通过政府的管制来消除和弥补市场失灵产生的问题,但由于政府本身掌握的信息也是不充分的,同时政府作为一个主体参与到市场活动中时,不可避免的会带有“经济人”的特性,反而造成市场失灵的加剧,所以政府的缺位、越位也是产生食品安全问题的重要原因。本文以绍兴县食品生产领域的现状为参考对象进行研究,在对前人相关论述进行梳理的基础上,尝试从厘清食品安全的相关概念入手,借助经济学和公共管理学等作为解决食品安全问题的理论依据,以历史分析的方法纵向回顾我国建国以来食品安全生产及监管体制的演变及发展,并就绍兴县的食品生产领域的现状展开深入分析。此外,若想更有效率的对食品安全问题提出解决方案,不能光着眼于国内。通过从法律体系、政府规制和技术支撑等三方面对美国等发达食品安全进行研究和探讨,总结各国的经验。在上述的基础上,分析了绍兴县生产领域食品安全管理体制和改革实践,寻找问题的成因和体制的缺陷。并着重通过分析茶叶制品的实例,尝试从法律法规完善、政府职能重构、公共参与治理等方面对改进绍兴县生产领域食品安全管理提出建议和对策。
[Abstract]:With the improvement of food quality requirements, food safety has become the focus of the whole society. To some extent, food safety can be defined as a public good, and the government has the responsibility and obligation to ensure the overall quality and safety of food. But the reality is that a variety of malignant food safety incidents emerge in endlessly, what can we eat-urgent torture of the current food safety regulatory system in China. Looking at the situation of food safety in our country, there are many problems, such as poor coordination among departments, immature laws and regulations, low efficiency of government regulation, fragmentation of regulatory system, division of interests, and so on. First, the market failure, the food safety risk caused by the wrong information in the whole food supply chain is the root cause of the food safety problem. Second, government failure, the government plays the role of watchman in the market economy environment, through government regulation to eliminate and make up for the problems arising from market failure, but because the government itself is not enough information, At the same time, when the government participates in the market activities as a main body, it inevitably has the characteristic of "economic man", which results in the aggravation of market failure. Therefore, the absence of government is also an important reason for food safety problems. Taking the current situation of food production in Shaoxing County as the reference object, this paper tries to clarify the relevant concepts of food safety on the basis of combing the related expositions of predecessors. With the help of economics and public management as the theoretical basis for solving food safety problems, the evolution and development of food safety production and supervision system since the founding of China were reviewed vertically by the method of historical analysis. And the current situation of food production in Shaoxing County is analyzed in depth. Moreover, more efficient solutions to food safety problems must not be domestic. Through the research and discussion on the developed food safety of the United States from the three aspects of legal system, government regulation and technical support, the experiences of various countries are summarized. On the basis of the above, this paper analyzes the food safety management system and reform practice in Shaoxing county, and finds out the causes and defects of the system. By analyzing the examples of tea products, this paper tries to put forward some suggestions and countermeasures to improve the food safety management in Shaoxing County from the aspects of perfecting the laws and regulations, reconstructing the government's functions, and managing the public participation.
