【摘要】:伴随着科学技术和交通运输业的进步,我国高速公路事业也取得了较快的发展。目前我国单靠政府财政投资无法从根本上解决公路建设资金问题,,因此,通过收取高速公路通行费来建设公路的方式已被社会各界所接纳。但是,随着时代的发展,社会各界对高速公路该不该收费的争议之声一直未停止,而实践中我国高速公路收费体制出现了很多的问题,这也让争议变得更加激烈。本文从行政法的角度出发,结合管理学等其他学科的相关理论,参考现实中的多个案例,试着对高速公路收费存在的问题进行研究,并运用行政法的手段进行规制,最终得以有效解决问题,实现高速公路收费的良性发展。 本文主体由以下五个部分构成: 第一部分,问题的引出。本部分开篇直接指出当前我国高速公路收费存在众多严峻的问题,并对主要问题进行列举。再结合当前实践中的一些案例,具体阐述一下高速公路收费存在的一些主要问题,将问题引出,以便后文对高速公路收费存在的问题进行良性的规制。 第二部分,高速公路收费的合理性。本部分论证了高速公路收费是否应取消这一现实争论存在的原因,通过对高速公路收费行为的法律地位和高速公路通行费的法律性质的探究,结合相关学科知识的判断,肯定了现今中国高速公路收费仍应存在的合理性;同时,研究了高速公路收费对中国社会、经济的作用,进一步肯定了高速公路收费仍应在中国继续的必然性。 第三部分,违规收费的法律规制。本部分是本文的重点部分,首先是对当前我国违规收费现象这一高速公路收费存在的重大问题的阐述,然后结合行政法的基础理论,寻求消除违规收费现象的有效措施。肯定了违规收费的规制应从行政机关和公众两方面力量的结合监管,才能实现违规现象的消除。 第四部分,收费标准的合理确定。本部分也是本文的重点论证所在,将论述的焦点转移到了高速公路收费存在的另一重大问题——收费标准的不规范上。首先是对收费标准具体存在的问题进行论证,然后将行政权的运行纳入到高速公路的收费管理活动中,以行政法的方法规制和调整高速公路的收费标准,使得收费标准实现规范化的目标。 第五部分,结语。结语部分探究到了高速公路收费存在众多问题的根本原因就在于高速公路收费管理的法律规范体系不健全,要求解决这一法律法规阙如的问题,实现高速公路事业的健康发展。
[Abstract]:Along with the progress of science and technology and transportation industry, the highway industry in China has also made rapid development. At present, the government financial investment alone can not fundamentally solve the problem of highway construction funds. The way to build highways by collecting tolls has been accepted by all walks of life. However, with the development of the times, the controversy over whether highways should be charged has not stopped. In practice, there have been many problems in China's highway toll collection system, which has also made the controversy more intense. This paper, from the perspective of administrative law, and combining with the relevant theories of other disciplines such as management, refers to many cases in reality. This paper tries to study the problems existing in expressway toll collection, and uses the means of administrative law to regulate and solve the problem effectively and realize the benign development of expressway toll collection. The main body of this paper is composed of the following five parts:. The first part, the introduction of the problem. At the beginning of this part, the author points out directly that there are many severe problems in expressway toll collection in our country, and enumerates the main problems. This paper expounds some main problems in expressway toll collection, and draws out the problems, so as to regulate the existing problems of expressway toll collection in the following articles. The second part, the rationality of freeway toll. By probing into the legal status of expressway toll collection behavior and the legal nature of highway tolls, and combining with the judgment of relevant disciplines, this paper confirms the rationality of expressway toll collection in China today, and at the same time, This paper studies the effect of expressway toll on Chinese society and economy, and further confirms the inevitability that expressway toll should continue in China. The third part, the legal regulation of illegal toll. This part is the key part of this paper, first of all, the exposition of the phenomenon of illegal toll in our country, the existence of major problems in expressway toll, and then combined with the basic theory of administrative law. This paper seeks for effective measures to eliminate the phenomenon of illegal charging and affirms that the regulation of illegal charges should be regulated by the combination of administrative organs and public forces in order to realize the elimination of irregularities. Part 4th, reasonable determination of charging standard. This part is also the key point of this article. The focus of the discussion has been shifted to another major problem in expressway tolling, that is, the non-standard of the toll standard. First, it demonstrates the specific problems existing in the toll standard. Then the operation of administrative power is brought into the toll management of expressway, and the standard of toll is regulated and adjusted by the method of administrative law, which makes the standard of toll realize the goal of standardization. Part 5th, conclusion. The conclusion part explores the fundamental reason why there are many problems in expressway toll collection, which lies in the unsound legal standard system of expressway toll collection management, which requires the solution of this problem that is lacking in laws and regulations.
