河北省高速公路建设项目合同管理研究

【摘要】：高速公路的建设对于国家经济发展至关重要,作为交通建设基础设施,高速公路对于社会、经济、环境发挥着至关重要的作用。高速公路在建设发展中具有资金量大、资金回笼周期长、合同管理繁琐复杂的特点。最近几年,为了解决高速公路建设项目建设过程中的合同管理问题,我国采用了项目业主自管与政府监管的相结合的方式,这一方式有效的保证了我国高速公路建设的顺利开展,但是在项目管理过程中,也不可避免地出现了很多问题,而缺乏对合同的科学管理模式和体系是最主要的问题。这些问题导致合同管理的理念和方式方法在高速公路建设项目建设过程中无法充分的发挥应有的作用。随着高速公路建设的迅速发展,加强对高速公路建设项目合同管理研究显得尤为重要。在本文的研究过程中,借鉴了国内外相关理论的经验和实践成果,与河北省高速公路建设发展过程中项目合同管理现状相结合,对河北省政府部门及其派驻管理机构在高速公路建设项目建设合同管理中发挥的作用进行阶段式分析,具体分析了项目业主单位在合同管理过程中应发挥的作用,同时分析了高速公路建设中合同管理方面面临的风险问题,最后在河北省高速公路合同管理实践中对科学管理的模式、原则等各个方面进行了论述。本文的研究出发点是高速公路建设项目合同管理,通过研究,提出了河北省相关政府部门或其派驻管理机构在高速公路建设项目合同管理中的问题,并有针对性的形成了改善高速公路建设项目合同管理模式和管理体制的建议,对于促进我国高速公路建设过程中科学的进行项目合同管理的实践具有一定的借鉴意义。
[Abstract]:Highway construction is very important for national economic development. As a transportation infrastructure, expressway plays a vital role in society, economy and environment. Expressway has the characteristics of large amount of funds, long period of return of funds and complicated contract management in the construction and development of expressway. In recent years, in order to solve the problem of contract management in the process of expressway construction project construction, China has adopted the combination of project owner self-management and government supervision. This method effectively ensures the smooth development of highway construction in China, but in the process of project management, there are inevitably many problems, and the lack of scientific management model and system of contract is the most important problem. These problems lead to the concept and method of contract management in expressway construction project construction process can not play its due role. With the rapid development of highway construction, it is particularly important to strengthen the research on contract management of expressway construction project. In the research process of this paper, we draw lessons from the experience and practice of relevant theories at home and abroad, and combine it with the current situation of project contract management in the process of highway construction and development in Hebei Province. The role of Hebei Provincial Government and its attached management agencies in the contract management of expressway construction project is analyzed in this paper, and the roles of project owners and units in the process of contract management are analyzed in detail. At the same time, the paper analyzes the risk of contract management in expressway construction, and finally discusses the scientific management mode and principle in the practice of highway contract management in Hebei Province. The starting point of this paper is the contract management of expressway construction project. Through the research, this paper puts forward the problems of the relevant government departments in Hebei Province or their attached management agencies in the contract management of highway construction projects. Some suggestions on how to improve the contract management mode and management system of expressway construction project have been formed, which have certain reference significance for promoting the practice of scientific project contract management in the process of highway construction in China.
