经天津出口铁路货物物权转移中的风险控制

【摘要】:自2008年国际金融危机以来,中国的进出口贸易量一直处于低增长或减弱的状况,美国以及欧洲的经济一直没有实现真正的复苏,国际贸易海上运输已经发展到一定的瓶颈期。与此同时我国同接壤的邻国经济一直是隐藏在欧美经济之下的不被关注的地带,然而这些经济体与中国之间的贸易却存在在巨大的潜力,我国同俄罗斯、蒙古、中亚诸国、朝鲜、越南等国家的贸易大多通过汽车或火车运输,诸如俄罗斯、蒙古、中亚国家甚至欧洲国家如果选择铁路运输,会比汽车运输节省更多的时间和费用。 本文主要通过研究国际贸易海上运输对于物权转移及风险的控制理论,结合国际贸易铁路运输自身的特点,通过理论联系实际的方法,提出现行国际贸易铁路运输在物权转移过程中存在的风险隐患,并对此隐患提出作者的意见,从而达到推动国际贸易铁路运输的发展的目的。 基于此,本篇论文从五个方面进行阐述,第一部分是绪论,介绍了本文的背景和意义,内容与方法以及国内外学者对于此项问题的研究成果。第二部分是相关理论概述,主要介绍了国际贸易铁路运输的基本概念、物权的概念以及物权在国际贸易中的重要性,为文章的写作奠定理论基础,确保论文研究的切实性。第三部分重点阐述了国际贸易海上运输货物在物权转移中的风险控制措施,国际贸易术语的应用对于风险控制的作用,、以及海运提单作为物权凭证对于收发货人在国际贸易中的平等地位等,为下一部分提出的国际贸易铁路运输在物权转移中存在的风险规避提供了理论支持和借鉴作用。第四部分介绍了国际贸易铁路运输货物在操作流程,以及在国际贸易各种成交方式中物权在何时转移,在转移点上收发货人各自面临的风险等,并提出了作者对于国际贸易铁路运输中存在的风险隐患,为下一步提出解决方法奠定了基础。第五部分是本篇论文的重点,通过前几部分的梳理,已经对于国际贸易铁路运输物权转移过程中存在的风险提出了问题,出口信用保险的推广等几方面,充分保障了铁路运输中收发货人的权益和利益。通过以上的制度和实际操作中的风险规避,尽可能的保障了国际贸易铁路运输的发展,达到了中国与接壤的邻国以及通过欧亚大陆桥方式进行贸易的其他国家的贸易进行推动的目的。文章最后是结论,对本文的论述进行了总结,也对于今后的铁路贸易进行了展望。
[Abstract]:Since the international financial crisis in 2008, China's import and export trade has been in a situation of low growth or weakening, the economy of the United States and Europe has not realized a real recovery, international trade and maritime transport has developed to a certain bottleneck period. At the same time, the economies of our neighboring countries have always been hidden under the economies of Europe and the United States, but there is great potential for trade between these economies and China, with Russia, Mongolia, and the Central Asian countries. North Korea, Vietnam and other countries trade mostly by car or rail, such as Russia, Mongolia, Central Asian countries and even European countries if they choose rail transport, it will save more time and cost than automobile transport. This article mainly through the research international trade sea transportation to the real right transfer and the risk control theory, unifies the international trade railroad transportation own characteristic, through the theory unifies the actual method, This paper puts forward the hidden risks existing in the transfer of real rights in the current international trade and railway transportation, and puts forward the author's opinions on the hidden dangers, so as to achieve the purpose of promoting the development of international trade and railway transport. The first part is the introduction, which introduces the background, significance, content and methods of this paper and the research results of domestic and foreign scholars on this issue. The second part is an overview of relevant theories, which mainly introduces the basic concepts of international trade and railway transportation, the concept of real right and the importance of real right in international trade, which lays a theoretical foundation for the writing of the article and ensures the practicality of the research. The third part focuses on the risk control measures of goods transported by sea in international trade in the transfer of real right. The role of the application of international trade terms in risk control, and the equal status of maritime bills of lading as documents of title for consignee and consignee in international trade, It provides theoretical support and reference for the risk aversion of international trade railway transportation in the transfer of real right. The fourth part introduces the operation process of international trade and railway transport goods, as well as when the real right is transferred in various ways of international trade, and the risks faced by the consignee and consignee at the transfer point, etc. The author also puts forward the hidden risks in the international trade and railway transportation, which lays a foundation for the next step. The fifth part is the focal point of this paper, through the combing of the first several parts, has raised the question to the risk existing in the process of the transfer of the real right of the international trade and railway transportation, the promotion of the export credit insurance and so on. Fully protect the rights and interests of consignors and consignors in railway transportation. Through the above system and the practical operation of risk avoidance, as far as possible to ensure the development of international trade and rail transport, It has achieved the purpose of promoting trade between China and its neighboring countries and other countries that trade through the Eurasian Continental Bridge. At the end of the article, the conclusion is given, the discussion of this paper is summarized, and the future of railway trade is also prospected.
