船载危险货物海上运输海事监管协同治理研究

【摘要】:船载危险货物海上运输因环节多、货物种类庞杂、运量大、运输环境特殊等特点,一旦发生事故经济损失及对周边环境和公众的影响难以估量。过往海事部门通过强力行政手段单部门开展行业监管的模式在过去十几年内起到了一定的作用,但在新的社会公共形势面前越来越力不从心,针对监管新局面,如何提供让行业和公众满意的公共服务成为海事部门需要研究的问题。本文引入协同治理理论,结合船载危险货物海上运输的特殊情境,对船载危险货物海上运输海事监管协同治理进行了较为详尽的研究,创新性地提出了我国船载危险货物海上运输海事监管协同治理的机制框架,并结合笔者工作实际提出了机制建设建议。本文除绪论、结论外,共分五个部分:第一部分梳理论文研究所涉及的专业概念和基础理论,并对我国船载危险货物海上运输海事监管协同治理的必要性和可行性进行说明。第二部分介绍我国船载危险货物海上运输海事监管协同治理的内容和手段,首先从监管系统各主体之间的关系出发分内部机构和外部系统分别介绍协同治理的内容,其次从法规、政策、经济、技术四方面介绍我国船载危险货物海上运输海事监管协同治理的手段。第三部分结合笔者工作实际,首先以浙江海事局为例对近年来危险货物运输形势及海事部门现有监管模式进行介绍,随后对我国船载危险货物海上运输海事监管现实困境和协同治理机制建设难点进行分析。第四部分在前几部分分析的基础上,首先对我国船载危险货物海上运输海事监管协同治理的指导思想、原则进行探讨;其次从参与各方利益目标诉求角度提出了协同治理目标,并对参与治理多元主体进行分类和权责界定;随后阐述了协同治理框架中保障、激励、监督、评估等五大机制的内容、作用、要求,最终形成了我国船载危险货物海上运输海事监管协同治理机制的整体框架。第五部分综合考虑现有监管模式存在的困境及协同治理机制的建设要求,从转变治理理念、完善协同机制这两个方面提出进一步提升我国船载危险货物海上运输海事监管协同力的对策。
[Abstract]:Because there are many links in the marine transport of dangerous goods, the types of goods are complex, the quantity of goods is large, the transportation environment is special and so on. Once the accident occurs, the economic loss and the influence on the surrounding environment and the public can not be estimated. In the past, the pattern of maritime departments to carry out industry supervision through strong administrative means has played a certain role in the past decade, but in the face of the new social and public situation, they are increasingly unable to cope with the new situation of supervision. How to provide public services to the satisfaction of the industry and the public has become a problem to be studied by the maritime sector. In this paper, the cooperative governance theory is introduced, and combined with the special situation of the marine transport of dangerous goods, this paper makes a detailed study on the cooperative management of maritime supervision and management of the shipborne dangerous goods by sea. This paper puts forward the mechanism framework of maritime supervision and management of shipborne dangerous goods by sea creatively, and puts forward some suggestions for the construction of the mechanism combined with the author's actual work. In addition to the introduction and conclusion, this paper is divided into five parts: the first part combs the professional concepts and basic theories involved in the thesis, and explains the necessity and feasibility of the cooperative management of maritime transport of dangerous goods by sea in China. The second part introduces the contents and means of cooperative management of maritime transport of dangerous goods by sea in China. Firstly, it introduces the contents of cooperative governance from the relationship between the main bodies of the supervision system and the external system, respectively. Secondly, this paper introduces the means of maritime supervision and management of China's shipborne dangerous goods by sea from four aspects: regulation, policy, economy and technology. In the third part, taking Zhejiang Maritime Bureau as an example, the author introduces the situation of dangerous goods transportation in recent years and the existing supervision mode of maritime department. Then it analyzes the practical difficulties of maritime supervision and coordination mechanism construction in China's shipborne dangerous goods maritime transport. On the basis of the analysis in the first part, the fourth part first discusses the guiding ideology and principle of the cooperative management of maritime transport of dangerous goods by sea in China, and then puts forward the goal of cooperative governance from the angle of the interests of the parties involved. Then, the contents, functions and requirements of the five mechanisms of ensuring, encouraging, supervising and evaluating in the framework of collaborative governance are expounded. Finally, it forms the overall framework of the cooperative management mechanism of maritime transport of dangerous goods by sea in China. The fifth part synthetically considers the predicament existing in the existing regulatory model and the requirements of the construction of cooperative governance mechanism, and changes the concept of governance. To improve the coordination mechanism, the countermeasures are put forward to further enhance the maritime coordination of maritime transport of dangerous goods in China.
