【摘要】:近年来,我国房地产市场迅猛发展,一定程度上推动了我国市场经济的发展,带来了一定的经济效益。但由于我国缺乏健全的房地产市场相关法律法规,出现了一系列的问题,如投机取巧,囤积房屋,哄抬物价,恶意炒作等。这些都直接导致我国房地产市场混乱、房价持续上涨,并远远超过了人们的预期承受能力。针对以上问题国家出台了一系列宏观调控政策,如“国十条”、“国五条”“国八条”等。实施这些政策以来取得了一些效果,,一定程度上调节了房地产市场,有效地遏制了房价的持续上涨。虽然效果显著,但不能从根本上解决房地产市场存在的问题。本文通过运用比较分析、实证研究、历史研究、法经济学的研究方法对房地产调控政策进行分析,反思其中所涉及到的经济法律问题。同时,也从经济法的角度试图对如何促进我国房地产市场的健康发展进行探讨。 首先,本文从两个方面分析了房地产市场宏观调控的基本理论问题,一方面,是理论基础,包括宏观调控法和不均衡的现状,另一方面,是法律基础,是指经济法对房地产市场进行宏观调控的依据。其次,从四个不同时期分析了我国政府实施的宏观调控政策,包括:信贷政策、土地政策、税收政策、法律政策等,以及分析了我国目前房地产市场宏观调控存在的问题,如,法律法规不健全、宏观调控力度不够等。然后,根据上文我国不同时期的房地产市场宏观调控政策,对其进行了概括性总结,并针对这些政策的合法性进行了研究。最后,根据对相关宏观政策的分析,从目标定位、立法支持、制度建设三个方面完善我国房地产市场的宏观调控政策。 本文通过对房地产市场宏观调控政策的基本理论和我国具体的宏观调控政策的分析,得出以下结论:一是,我国必须加强对房地产市场的监督,但不能过度干预,主要采用经济和法律的手段;二是,政府要保证政策的合法性,即制定主体和制定程序的合法性,这样才能保证政策的有效实施;三是,政府要在制定过程中保证政策的整体性和长远性,只有政策真正的有效和合法才能够被实施。以上是本文得出的一些研究成果,也是本文的创新之处。
[Abstract]:In recent years, the rapid development of China's real estate market, to a certain extent, has promoted the development of China's market economy, brought certain economic benefits, but due to the lack of sound real estate market laws and regulations. There are a series of problems, such as opportunistic, hoarding, hoarding, hoarding, malicious speculation and so on, all of which directly lead to the chaos of the real estate market in China, housing prices continue to rise. In response to the above problems, the state has issued a series of macro-control policies, such as "National Ten articles". Since the implementation of these policies, some effects have been achieved, to a certain extent, the real estate market has been adjusted, and the continued rise in house prices has been effectively curbed, although the effect has been remarkable. But can not fundamentally solve the real estate market problems. Through comparative analysis, empirical research, historical research, law and economics research methods of real estate regulation and control policy analysis. At the same time, it tries to discuss how to promote the healthy development of China's real estate market from the angle of economic law. First of all, this paper analyzes the basic theory of real estate market macro-control from two aspects, on the one hand, is the theoretical basis, including macro-control law and unbalanced status, on the other hand, is the legal basis. It refers to the basis of macroeconomic regulation and control of the real estate market by economic law. Secondly, from four different periods, the author analyzes the macro-control policies implemented by our government, including: credit policy, land policy, tax policy. Law and policy, as well as the analysis of the current real estate market macro-control problems, such as, laws and regulations are not perfect, macro-control efforts are not enough. Then. According to the macro-control policies of China's real estate market in different periods, this paper makes a general summary, and studies the legitimacy of these policies. Finally, according to the analysis of the relevant macro policies. The macro-control policy of China's real estate market should be improved from three aspects: target orientation, legislative support and system construction. This article through the real estate market macro-control policy basic theory and our country concrete macro-control policy analysis, obtains the following conclusion: first, our country must strengthen the supervision to the real estate market. But cannot intervene excessively, mainly uses the economic and the legal means; Second, the government should guarantee the legitimacy of the policy, that is, the legitimacy of the formulation subject and the formulation procedure, so as to ensure the effective implementation of the policy; Third, the government should ensure the integrity and long-term nature of the policy in the process of formulation, only the policy can be implemented effectively and legally. These are some of the research results obtained in this paper, and also the innovation of this paper.
