商品房预售资金监管效果的影响因素研究

【摘要】:预售资金作为我国房地产开发的主要资金来源之一,能够缓解房地产开发商资金压力,对其的监管是我国实行预售制度以来一直关注的问题之一。然而,从各城市商品房预售项目实施情况来看,预售资金监管的效果并不尽人意。一些房地产开发商抽逃、挪用资金,造成资金周转不灵甚至断裂现象时有发生,极大的损害了预购人的利益,其主要原因之一就是对预售资金监管不到位。通过对预售资金监管的研究,识别并分析监管效果的各种影响因素,根据分析得出的结果,为预售资金监管体系的建立提供理论基础,采取措施强化积极因素的有利影响,消除不利因素对于预售资金监管效果的制约,促进预售项目的顺利完成,保护预购人权益,实现房地产市场的稳定。 本文运用理论与实证相结合的方法,首先对预售资金监管行为的各个要素进行分析,并结合预售资金监管的实际,在分析预售资金监管中存在问题的基础上,探讨预售资金监管效果的影响因素,在阅读大量文献的基础上,自行量表设计,运用SEM结构方程模型,构造预售资金监管的影响因素模型,通过调查问卷方式对预售资金的相关各方获得数据,进行实证分析,揭示预售资金监管各个影响因素之间的相互联系。基于实证结果,可以为完善预售资金监管体系提供立论依据,针对影响中的重要因素,提出改进预售资金监管效果的有效措施。本文得出的主要结论是: 1.商品房预售资金监管过程中,预售资金监管效果由预售资金监管法律法规、举报制度、监管能力三个因素协同作用。预售资金监管法律法规的完善,促进预售资金监管举报制度的健全,举报制度的健全也对商品房预售资金监管的法律法规形成有益的补充法律法规、举报制度除了直接影响监管效果外,也制约着监管能力。 2.从模型的观察变量和潜在变量之间的影响关系来看,,监管协议的订立、违法违规的查处、监管的手段、监管激励以及举报相关制度等路径影响系数较大,表明在监管过程中产生较大影响,因此,在完善商品房预售资金监管制度时,应重要考虑这几方面的因素,而对于监管效果的评价,投诉率以及及社会满意度的高低能有效反应出监管效果的好坏。 3.通过模型分析结果,有针对性地对改善预售资金监管效果提出相关措施。通过明确监管协议内容、加大违法违规查处力度、消减举报风险、创新举报方式、选择合适的监管机构并丰富监管手段等措施来完善监管法律法规,从而改善预售资金监管效果。
[Abstract]:As one of the main sources of funds for real estate development in China, pre-sale funds can alleviate the financial pressure of real estate developers. The supervision of pre-sale funds has been one of the problems that our country has been concerned about since the implementation of pre-sale system. From the implementation of commercial housing pre-sale projects in various cities, the effect of pre-sale funds supervision is not satisfactory. Some real estate developers run away, misappropriating funds, resulting in the phenomenon of capital turnover is not working or even breaking. One of the main reasons is that the supervision of pre-sale funds is not in place. Through the research on the supervision of pre-sale funds, we can identify and analyze the various factors that affect the effect of supervision. According to the results of the analysis, for the establishment of pre-sale funds supervision system to provide a theoretical basis, take measures to strengthen the positive factors of the favorable impact, eliminate the adverse factors on the pre-sale funds regulatory effect constraints. Promote the smooth completion of pre-sale projects, protect the rights and interests of buyers, realize the stability of the real estate market. This paper uses the combination of theory and empirical method, first of all to analyze the various elements of the pre-sale fund supervision behavior, and combined with the actual pre-sale fund supervision, on the basis of analyzing the problems in the pre-sale fund supervision. On the basis of reading a lot of literature, we design the scale and construct the influence factor model of pre-sale fund supervision by using SEM structural equation model. Through the questionnaire to the relevant parties to obtain data, empirical analysis, reveal the relationship between the various factors affecting the supervision of pre-sale funds. Based on the empirical results. It can provide theoretical basis for perfecting the supervision system of pre-sale funds, and put forward effective measures to improve the effect of supervision of pre-sale funds according to the important factors in the influence. The main conclusions of this paper are as follows: 1. In the process of supervision of commercial housing pre-sale funds, the effect of pre-sale funds supervision is coordinated by three factors: the laws and regulations of pre-sale funds supervision, the reporting system, and the supervision ability, and the perfection of the laws and regulations of pre-sale funds supervision laws and regulations. To promote the supervision and reporting system of pre-sale funds, the sound reporting system will also form beneficial supplementary laws and regulations for the supervision of commercial housing pre-sale funds, in addition to the direct impact of the reporting system on the effect of supervision. It also restricts the ability of supervision. 2. From the perspective of the relationship between the observed variables and potential variables of the model, the conclusion of regulatory agreement, the investigation and punishment of violations, the means of supervision, the incentive of supervision and the reporting of related systems have great influence factors. It shows that there is a great influence in the process of supervision, therefore, when perfecting the supervision system of commercial housing pre-sale funds, we should consider these factors and evaluate the effect of supervision. Complaints and social satisfaction can effectively reflect the effectiveness of supervision. 3. Through the results of model analysis, the paper puts forward relevant measures to improve the supervision effect of pre-sale funds. Through defining the content of the supervision agreement, it increases the investigation and punishment of violations and offenses, and reduces the risk of reporting. To improve the regulatory effect of pre-sale funds, we should innovate the way of reporting, select appropriate regulatory bodies and enrich the means of supervision and other measures to improve the regulatory laws and regulations.
