【摘要】:农地流转是解决“三农”问题的关键,推动农业产业升级,促进农村经济发展,需要走一条现代化规模经营的道路,农地流转是使农地规模化运作的最有效手段,充分发挥农地流转的作用,需要巨额的资金支持。传统的融资方式有诸多弊端,而作为新兴融资方式的土地证券化便脱颖而出。本文通过对农村土地证券化这种农村金融创新方式的研究来破解农村土地流转及流转之后土地规模经营、农业产业化经营资金短缺的难题,以期达到实现农业现代化,提高农民收入水平,缩小城乡差距,为解决“三农”问题尽一份绵薄之力。 本文主要运用跨学科研究、理论与调查研究相结合等研究方法。“证券化”本身是一个金融学研究的范畴,但土地证券化又离不开法学的研究,文章内容还涉及产权等新制度经济学以及福利经济学的内容。所以,对农村土地证券化的研究必须从经济学、金融学、会计学和法学等学科多角度综合研究。通过直接的乡村实地调查、设计调查问卷及间接的信息搜集、事后数据处理,了解农民、企业和政府对农村土地证券化的理解和反应。同时运用经济学的理论,认真分析实地调研所获得的数据与资料,形成自己的结论。 本文首先对国内外有关文献进行综述,包括国外资产证券化和不动产证券化的研究以及国内农村土地证券化的研究进展,然后,对基本概念进行界定并阐述基础理论。以此为出发点,在借助对国外不动产证券化和国内未来收益证券化实践经验以及我国特殊农村土地制度与政策的研究,认识农村土地证券化的必要性与可行性。之后,在阐述资产证券化原理与各主体的基础上,研究农村土地证券化模式,结合土地流转和农业产业化经营,,着重分析论证以农业企业(土地使用者)为发起者的土地未来收益为担保这种证券化模式。之后,进行农村土地证券化的技术分析——定价分析,详细论述土地流转中对农民的补偿定价,“增人增补偿,减人减补偿”这种农村土地流转补偿定价方式也是本文的创新点。 本文研究的主要结论是农村土地流转与农村土地证券化是两阶段的关系,土地流转是第一阶段,土地证券化是第二阶段,将土地收益证券化是为了解决土地流转之后的农地规模经营和农业产业化经营的资金短缺问题。农村土地证券化将会对传统意义上的资产证券化理论有所突破,在实践中存在诸多障碍,农村土地证券化的顺利实施,需要理论上的创新,制度、法律、政策等保障并大胆实践。
[Abstract]:Agricultural land circulation is the key to solve the problem of "agriculture, rural areas and farmers". To promote the upgrading of agricultural industry and the development of rural economy, it is necessary to take a road of modern scale management. Agricultural land transfer is the most effective means to make the scale of farmland operation. It needs a huge amount of financial support to give full play to the role of agricultural land transfer. There are many drawbacks in the traditional financing method. Land securitization as a new form of financing will stand out. Through the study of rural land securitization the rural financial innovation to solve the rural land circulation and land scale management after the circulation. In order to realize the modernization of agriculture, raise the income level of farmers, narrow the gap between urban and rural areas, we can do our best to solve the problem of agriculture, rural areas and farmers. This paper mainly uses interdisciplinary research, theory and investigation and other research methods. "Securitization" itself is a financial research category, but land securitization can not be separated from the study of law. The content of the article also involves the contents of new institutional economics such as property rights and welfare economics. Therefore, the study of securitization of rural land must be based on economics and finance. Through the direct rural field investigation, the design questionnaire and indirect information collection, afterwards the data processing, understands the farmer. The understanding and response of enterprises and governments to the securitization of rural land. At the same time, by using the theory of economics, the data and data obtained from the field investigation are carefully analyzed, and their own conclusions are reached. This paper first reviews the relevant literature at home and abroad, including the study of foreign asset securitization and real estate securitization as well as the research progress of domestic rural land securitization, and then. To define the basic concepts and elaborate the basic theory, as a starting point, with the help of foreign real estate securitization and domestic future income securitization practical experience as well as China's special rural land system and policy research. After understanding the necessity and feasibility of rural land securitization, on the basis of expounding the principle and main body of asset securitization, the paper studies the mode of rural land securitization, combining land circulation and agricultural industrialization management. Focus on the analysis of agricultural enterprises (land users) as the initiator of land as the guarantee of the securitization model. After that, the rural land securitization technical analysis-pricing analysis. This paper discusses in detail the compensation pricing for farmers in the land circulation. "increasing people compensation, reducing people compensation", the rural land circulation compensation pricing method is also the innovation of this article. The main conclusion of this paper is that the relationship between rural land circulation and rural land securitization is two stages, land circulation is the first stage, and land securitization is the second stage. The purpose of securitization of land income is to solve the problem of capital shortage of agricultural land scale management and agricultural industrialization management after land circulation. Rural land securitization will break through the theory of asset securitization in the traditional sense. There are many obstacles in practice, the smooth implementation of rural land securitization needs theoretical innovation, system, law, policy and other safeguards and bold practice.
