养老信托监管法律制度研究

【摘要】：根据我国国家统计局2015年统计公报显示,现今中国已全面进入老龄化社会。信托是一种超越金融的制度形式,能够为中国养老产业的发展做出自己独特的贡献。养老信托具有综合性的特征,既具有养老服务功能和金融功能,在金融领域极具创新性。养老信托是一种创新型信托模式,其风险自然有其特殊性。我国经济的高速发展时代即将终结,泛资产管理时代已经到来,加强金融服务业的监管应未雨绸缪,也可认为是经济和社会发展的必由之路。养老信托产品的相应快速推出,使养老信托业务逐渐在全国范围内展开,然而养老信托内在的一些特征会导致受托人权力过大,如果不加以合理监管,将损害养老信托委托人和受益人的利益甚至危及到地区性的经济安全。本文对养老信托的概念和特点进行了梳理,并分析了养老信托监管的主体、内容和价值,研究了域外养老信托监管制度的相关规定,并结合我国养老信托监管在实践中的问题,分析了在我国现有法律环境和监管制度下,养老信托监管在立法、政府监管、监管主体和信托公司行业内部监管四个方面存在的问题和不足。本文从四个方面提出了养老信托监管的法律建议:第一,完善养老信托监管立法——《信托业法》;其次,改变政府以往的严格监管方式,适用政府适度监管;第三,确定养老信托监管主体。合理安排监管机构的选择和设立,对养老信托科学监管;第四,健全行业内部监管体制改革,具体要加强信托公司能力建设,加强信托公司资产管理和风险预防。
[Abstract]:According to the 2015 statistics bulletin of the National Bureau of Statistics, China has now entered an aging society. Trust is a system that transcends finance and can make its own unique contribution to the development of pension industry in China. The endowment trust has the comprehensive characteristic, not only has the pension service function and the financial function, but also has the innovation in the financial field. Endowment trust is an innovative trust mode, and its risk has its particularity. The era of rapid economic development in China is coming to an end, and the era of pan-asset management has come. Strengthening the supervision of financial service industry should be prepared ahead of a rainy day, which can also be regarded as the only way to economic and social development. The corresponding rapid introduction of the trust products for the aged makes the business of the trust for the aged develop gradually in the whole country. However, some inherent characteristics of the trust will lead to too much power of the trustee, if it is not properly supervised, Will harm the interests of trust clients and beneficiaries of pension and even endanger regional economic security. This paper combs the concept and characteristics of endowment trust, analyzes the main body, content and value of pension trust supervision, studies the relevant regulations of overseas pension trust supervision system, and combines the problems in practice of pension trust supervision in our country. Under the existing legal environment and supervision system of our country, this paper analyzes the problems and shortcomings of the supervision of trust for the aged in four aspects: legislation, government supervision, supervision subject and the internal supervision of trust company. This paper puts forward four legal suggestions on the supervision of the trust for the aged: first, to perfect the legislation on the supervision of the trust for the aged-"Trust Industry Law"; secondly, to change the strict supervision mode of the government in the past, and to apply the appropriate supervision by the government; third, To determine the main body of pension trust supervision. Rational arrangement of the selection and establishment of regulatory bodies, scientific supervision of trust pension; fourth, improve the industry internal regulatory system reform, specifically to strengthen the capacity of trust companies, strengthen trust company asset management and risk prevention.
